Hundreds of happy winners of the housing price in the ultra-Orthodox city of Elad are forced to pay out of their own pockets for delays in building permits. Meanwhile, hundreds of yeshiva students have been housed in a way that could endanger their lives.



The reason for all this: the Ministry of Construction and Housing, which is supposed to solve the plight of young couples, does not provide a solution to an acoustic wall that blocks the entire project. The Ministry of Housing blames the Ministry of Transportation, who blames the Ministry of Housing and so on. A complaint was even forwarded to the State Comptroller for inspection. On



July 22, the Y. D. Barzani company won a price tender for a tenant that was approved by the local committee (permit subject to conditions) on 02.07.23 (a year ago). However, according to the TPBA applicable in the area, a building permit cannot actually be issued until an acoustic wall separating the project from the road is built. The responsibility for building the wall rests with the Ministry of Construction and Housing, which does not build the wall and delays obtaining the permit.

Lost rent and opportunities to buy an apartment for two years

"I am appealing on behalf of hundreds (!!) of winners, 277 in number, who pay rent and lose tens of thousands of shekels each from this negligence. What's more, there is another project for which the winners have already signed a contract and pay the mortgage at the same time as the rent. This project is also stuck thanks to the Ministry of Housing and Construction." Number one winners.



The developer (Y. D. Barzani) wrote to the winners via email that he is considering canceling the tender because of the matter.

A troubling thing in itself, because if it does happen - it is doubtful if Remy will find another developer interested in the project, and therefore the winners, most of them young families, waited two years in vain and lost rent and opportunities to purchase an apartment, so as not to lose the right to a price for a tenant.

Recall that housing prices have increased by more than 20% since then.



There are two solutions to the matter:

one - to change the TBA;

The second, and the simplest - that the ministry fulfills its obligations to build the wall.



The municipality tried to go with the first solution, and to change the TBA in order to change the condition of building the wall, which would be a condition of Form 4 and not a condition for a building permit.

However, objections were submitted and the discussion was transferred to the district committee for planning and construction, which rejected the request.

They endangered the lives of 500 yeshiva students

As part of the objections submitted to the change of the IBA, they accepted the mayor who lived in a yeshiva complex with 500 students, and therefore - it is considered as if they had brought Form 4 and therefore the construction of the wall cannot be postponed. The representatives of the municipality did not participate in the discussion that was transferred to the district, and it ended with the municipality having to provide an answer within 30 days (from November 22, 2023).



In addition, the objection claims that according to the committee's transcript, the representative of the local authority said that the yeshivas in the compound are occupied by students, but that an occupancy permit was not issued - while the protocol states that the same representative only says that the compound is apparently populated according to the circumstances, not according to the permit. "In the transcript appears a very important sentence in essence from the representative of the Ministry of Environmental Protection indicating that buildings were also inhabited by students without a permit, without any enforcement being carried out in a way that endangers the students," the objection reads.



The decision of the district committee states, among other things, that Sitting nearby is done with the possibility of a health risk due to the proximity to fuel tanks and a bus terminal nearby.



As of this moment, no responses have been received from the Ministry of Housing and the entrepreneurial company.
