Chiara Ferragni will be able to be interviewed by Fabio Fazio in the next March 3 episode of the program Che Tempo Che Fa. This is the meaning of the monocratic precautionary decree of the TAR of Lazio, in response to the request with which Codacons requested the ascertainment of the illegitimacy of the silence maintained by Agcom on the warning presented on February 23rd as well as for ascertaining the validity of the claim of compliance with the rules on information pluralism;

also containing the request to the Authority itself to require the television network and Fabio Fazio to announce or broadcast a video during the interview, to make viewers aware of the content of the story relating to Ferragni herself.

The section president of the TAR, considering that the feared prejudice "is of a purely hypothetical nature, as it is substantiated by conduct having a future temporal position and non-predictable content", ruled out the possibility of proceeding at present with "the administration (although conveyed by an intervention of the Communications Authority) of rules of conduct, regarding the conduct of a television broadcast, clearly beyond the dispositive powers of the administrative judge in question", also because in any case "they affect interests having primary constitutional protection, such as freedom of expression and the protection of confidentiality".

Furthermore, according to the TAR, "conduct possibly implemented in violation of the current regulatory rules governing the correctness, completeness and impartiality of television information are well suited to being examined by the competent Authority for the purpose of adoption - in presence, obviously, of the necessary conditions - of the expected repressive and/or sanctioning measures".

The effect: urgent precautionary request rejected and setting for the collegial discussion of the appeal to be held in chambers on March 13th.
