There is a risk of high fines in Italy: the law is back in force – rule for the warning sign on the car

The important change affects all drivers who travel with bicycles, but also with skis or snowboards on a rear rack.

Since a change in the law in August 2023, rear carriers with repeat license plates and their own lighting have been exempt from the obligation to attach a red and white warning sign.

But this regulation has been suspended again: even illuminated and marked rear racks now require a warning sign.

Anyone who does not comply with this risks a fine of at least 80 euros, as the ADAC informs.

Basically, according to the ADAC, anyone who transports something in Italy that extends beyond the rear or uses a rear rack must attach a red and white warning sign.

If the load protruding to the rear takes up the entire width of the vehicle, two of the aforementioned warning signs must be attached to the left and right at the side end of the load.

The warning sign attached to the rear of the vehicle should be made of sheet metal, must have dimensions of at least 50 × 50 centimeters and be hatched red and white (five red stripes).

Another hurdle for taking bikes with you are the regulations for securing loads.

In Italy, bicycles are not allowed to be wider than the car itself. According to the road traffic regulations, the load is generally allowed to protrude 30 centimeters beyond the tail lights, but this does not apply to so-called difficult-to-see loads.

According to the new Italian road traffic regulations, bicycles are difficult to recognize and therefore cannot be wider on the rear rack than the car itself. These bicycles, which are classified as “difficult to recognize load”, can lead to severe penalties if they are violated.

According to ADAC, a fine of up to 345 euros is possible.

Travelers whose bikes stick out over the taillights should definitely consider whether they actually want to travel to Italy loaded like that.

There is currently no legal certainty, as a court decision is not expected until summer 2024 at the earliest.
