Almost a paradox, designed, however, to protect, especially in the case of the mother, the right to anonymity of the woman who decides to renounce motherhood and give her child up for adoption.
But the right of children, of the thousands of adopted children, who want to be recognized as having the possibility of knowing their origins, has instead taken a back seat.
At least until a director and two esteemed actors lifted the veil on these issues with a very recent film.
And at least until the issue is reopened in Parliament, where the M5s senator, Elisa Pirro, has presented a motion that deals with it.
The objective is in fact to find a greater balance between the mother's right to privacy in the event of an anonymous birth and the adoptee's right to know his origins.
In our system, anonymous birth is protected, however the choice of secrecy regarding the mother's identity has become a reversible choice (and no longer absolute), following a ruling by the 2013 Council: at the request of the child, the parent can revoke the declaration of anonymity made at the time.
But that's all.
"The search for one's origins is a key step in the process of defining one's identity, for these reasons I have presented a motion aimed at balancing the rights of children to know them with those of mothers who give birth anonymously" says the 5 star senator who next week (Wednesday 13 March at 6pm) will present the parliamentary initiative and, on that occasion, will also screen some clips of the film directed by Alessandro Bardani, with Sergio Castellitto and Valerio Lundini and the singer-songwriter Brunori Sas, 'The most beautiful century of my life'.
"We don't know who we are if we don't know where we come from" says Lundini in a passage from the film that will cross the door of Palazzo Madama, with the president of the Adoptive Children and Natural Parents Association Luisa Di Fiore and the magistrate Alfonso Sabella.
'The most beautiful century of my life' is the first film to deal with the so-called 100-year law of 1983. "I am very happy that the film has made so many people aware of the existence of this absurd law and has awakened a civil conscience in the institutions; giving new life to a battle that deals with unrecognized children, becoming the manifesto of this fight so far not recognized by the political world", states the director.
"The regulatory void determined by the ruling of the Council - adds Alfonso Sabella - must be filled as soon as possible to ensure, at least, the equality of citizens before the law which is currently nullified by the different practices and different interpretative criteria adopted by the individual Courts for minors in the absence of regulations having the force of law".
"The human right to one's identity and consequent psychophysical health is undermined by the darkness of one's biological history" highlights Di Fiore who concludes: "I have been fighting for twenty years to see this right recognized and to bring common thought alongside those who have this right he doesn't have it."
