The European Court of Justice, acting on behalf of the Advocate General, did not accept the urgent preliminary ruling made by the Court of Cassation on the application of the Cutro decree.
The decision was made on 26 February and was made known by the lawyer Rosa Emanuela LoFaro, lawyer for migrants held in Pozzallo, on whom the appeal also dealt with by the judge of Catania, Iolanda Apostolico, is focused.
The case before the European Court will be treated with the ordinary procedure: "Now - explains the lawyer - I have two months to present a brief and then the judges will set the date of the hearing".
