 "In recent days, a television crew occupied a private space belonging to John Elkann's private home in Turin to carry out video recordings using a drone. As subsequently emerged, the filming was carried out for the Porta a Porta broadcast. In the face of this unjustifiable intrusion into the private life of our client, moreover carried out by state TV, and to protect his privacy and that of his family which also includes three minors, today we announce a lawsuit against all those responsible, warning the editorial staff of Porta a Porta from repeating similar behavior, as well as from using in any way any image thus obtained".

This was made known by the lawyers of John Elkann, Paolo Siniscalchi, Federico Cecconi and Carlo Re.


    "Furthermore, given the continuation of the current climate of media aggression which goes beyond the boundaries of the right of reporting and criticism - they continue -, John, Lapo and Ginevra Elkann have given us the mandate to protect their reputation through appropriate judicial initiatives, warning anyone from the dissemination of untrue and defamatory articles and press reports".

And the lawyers' response

Regarding the announced complaint by John Elkann on Porta a Porta for alleged violation of his privacy with the use of drones, a note from the program specifies that "the film maker of the programme, equipped with a regular flight licence, has stopped making resumed after the invitation of the security of the Elkann house".

"Those images have not been and will not be broadcast - continues the note -. Furthermore, the Privacy Guarantor clarifies in a note dated September 2021 that the use of images taken by drones for journalistic purposes is permitted even without the consent of the interested parties , without prejudice to obvious precautions such as not filming people, license plates and other identifying elements. In any case, having registered the dissent of Elkann security, we avoided transmitting the images".



The reply from John Elkann's lawyers to Porta a Porta: "The Privacy Guarantor states an obvious principle: the use of drones for "journalistic purposes" is not prohibited, which occurs when the journalist intends to publish facts of public interest (for example a demonstration or a news story). The filming of places of private residence, where minors live, is equally obviously absolutely prohibited, in consideration of the inviolability of the home envisaged by the Constitution and protected by criminal sanctions".
