The Federal Council finally voted for the legalization of cannabis on March 22nd.
It's free to smoke weed in public, but that doesn't apply everywhere.
Munich – After numerous debates and discussions, there is finally certainty: the Federal Council has made a decision on the cannabis law.
From April, the consumption and possession of cannabis will be partially legalized in Germany.
However, the Bavarian police union criticizes the decision - among other things because of the danger of increasing consumption.
In 2021 alone, at least 4.5 million adults consumed cannabis in the last 12 months, according to a survey by

The age group between 18 and 24 years is particularly affected.
However, the cannabis law is also intended to protect children and young people, which is why it is still far from legal to smoke weed in every place.

The recently passed Cannabis Law not only allows the legal consumption of cannabis, but also its possession.
According to the Federal Office of Public Health, every adult is allowed to possess and carry up to 25 grams of cannabis.
In addition, per adult person in a household is permitted to grow a maximum of three cannabis plants at the same time for their own consumption at home, provided that the person has lived in Germany for at least six months.
In order to pave the way for cultivation, cannabis seeds from EU countries can now also be ordered over the Internet.
“However, no unreasonable nuisance or disruption may be caused to the neighborhood,” as can be seen from the
Federal Ministry of Health
’s questionnaire on the Cannabis Act .

Places where the consumption of cannabis is still prohibited to protect children and young people
But just because possession and consumption should become legal does not mean that the “joint” can be pulled everywhere and in every situation.
According to a lawyer, drug use while at work is not recommended as action may follow under labor law.
Restricted consumption was also decided in the Cannabis Act to protect children and young people.
According to the
Federal Ministry of Health
, cannabis may not be consumed in the following situations and places:
Consumption in the presence of minors is prohibited.
Smoking weed is not permitted within sight (a distance of more than 100 meters) of schools.
Consumption is also prohibited within sight of children's and youth facilities and children's playgrounds.
Smoking weed is also prohibited within sight of publicly accessible sports facilities (e.g. football pitches).
Consumption is also not legal within and within the sight of cannabis cultivation associations.
Smoking weed is also not permitted in the pedestrian zone between 7 a.m. and 8 p.m.
Cannabis remains strictly prohibited in military areas.
