Highlights: Attacks on health workers, from today we will proceed automatically - Healthcare. It is a further step forward to protect colleagues victims of aggression and violence in the exercise of their duties. This is the comment of the National Secretary of Anaao Assomed, Pierino Di Silverio following the publication in the Official Journal of the legislative decree of 19 March 2024, n. 31. The decree modifies the penal code regarding the ex officio prosecution for the crime of personal injury and the prosecution of the crimes of damage upon complaint.


"From today it is possible to proceed ex officio even in the case of personal injuries to healthcare professionals, whether they are minor, serious or very serious, therefore regardless of the victim's desire to file a complaint. (ANSA)

This is the comment of the National Secretary of Anaao Assomed, Pierino Di Silverio following the publication in the Official Journal of the legislative decree of 19 March 2024, n.

31 which modifies the penal code regarding the ex officio prosecution for the crime of personal injury and the prosecution of the crime of damage upon complaint.


    "The intervention was necessary - explains Di Silverio - to coordinate the changes already introduced to the regime of prosecution of the crime of injury in 2022 with the reform of the criminal trial, to the subsequent modification, desired by Anaao, and made by the legislator to the Code penalty, from the so-called bill decree".


    "Already with the 2023 bill decree, - recalls Di Silverio - the legislator, in response to a request from the Anaao, had intervened to strengthen the criminal regulatory system to protect healthcare personnel in the exercise of their functions and activities, in consideration of the episodes of violence which have occurred several times in healthcare facilities, with the introduction of a tightening of sanctions with regard to simple injuries for which the punishment of imprisonment from two to five years is now foreseen".


    "This innovation - concludes Di Silverio - represents a further step forward in the defense of colleagues who are victims of aggression and violence in the exercise of their duties. We are now asking for immediate organizational measures to complete the protection action".
