Accompanied by his lawyer, Ines Guardiola, and escorted by the police, the former Brazilian footballer Dani Alves left the Brians 2 prison in Barcelona, where he had been detained for the last 22 months for the rape of a 23-year-old girl in the night between 30 and 31 January 2022 in the Sutton nightclub in Barcelona.
A sexual assault for which he was sentenced at first instance last month to 4.5 years in prison and the payment of 150,000 euros in compensation to the victim.
Alves made no statement.
Two hours earlier, the Court of Barcelona had confirmed that the Brazilian footballer's defense had paid bail of 1 million euros, and handed over his two passports - Brazilian and Spanish - as required by the precautionary measures for his return to probation, in waiting for the definition of the process.
And he ordered the magistrate on duty to release him.
Alves, who will not be able to leave Spain, has been required to sign weekly every Friday in court and will not be allowed to come within 1 km of the rape victim.
The former Barcelona, Juve and PSG full-back took longer than expected to raise the bail money, set by the court last Wednesday - at the request of Alves' defence, after having served a quarter of the sentence - due to the difficult situation financial, after the breaking of the contract by the Mexican club Pumas, in the aftermath of the accusation of sexual violence.
And for the seizure of assets following the proceedings initiated against him by his ex-wife and mother of his children.
The 4.5 year prison sentence is half of the 9 years that had been requested by the public prosecutor, who had also opposed the release of the former footballer and announced an appeal.
During the trial, the Brazilian who initially denied having had relations with the victim, then claimed that they had been consensual, and then admitted the violence, claiming to have been impaired by the state of intoxication.
The civil lawyer, the victim's defender, also announced an appeal against the first instance sentence and the Brazilian's provisional freedom, which could therefore be revoked with a subsequent provision.
