The urban Daspo with a ban on access to certain areas of the city, such as stations and squares in front of the accesses to railway yards, can be applied to people who behave in ways that give rise to the fear of committing crimes, however this prevention measure must not, in conclusion, "to be understood as aimed at removing 'idlers and vagabonds', as was also stated in the broad parliamentary debate that developed during the conversion of Legislative Decree 14 of 2017. This was underlined by the Consulta in sentence 47 filed today which dealt with an appeal raised by the Court of Florence which had doubts about similar Daspo which would entail, in his opinion, "a limitation of the recipient's freedom of movement, inhibiting him for a long period of time from accessing certain areas of the city, which are normally freely usable".


    The case that ended up before the Court of Florence concerned a man who had not respected the Daspo which prohibited him from accessing the Santa Maria Novella station and two side streets, after having been caught several times insistently asking for money from people who bought tickets at the automatic machines or who took the stairs.
