A woman was
sentenced to pay her ex-husband almost 13 million pesos in compensation for "sharing him on the networks
."
The Justice investigation, which lasted three years, determined that she also harassed him with different false profiles on social networks.
The ruling was announced this Tuesday, in a hearing held by the Justice of Control and Guarantees of La Banda, in Santiago del Estero.
The woman in question was convicted of
slander and libel
.
"This is an exemplary ruling that is given for the first time in Santiago del Estero and that sets precedents for future cases in the province," said Rolando Gómez Vélez, lawyer for the complaint.
In a conversation with Channel 7, the lawyer recounted some of the particularities of the case, which he defined as a "judicial odyssey" because disputes related to the care of the couple's children were also at stake.
"The process began before the pandemic, when a woman, not happy with the separation from her partner, began
to criticize him through numerous publications on social networks
. We sent her a letter to inform her to stop the publications, under the warning of initiate criminal and civil actions. He never responded to the document letter and it gave rise to filing a complaint for slander and slander," he explained.
In slander it refers to the false imputation of a crime;
while injury affects the reputation and honor of the injured person.
And he added: "This made it possible for Justice to access her cell phone and it was possible to verify that she was the owner of
an innumerable number of profiles on the networks that defamed my client
. This, added to countless screenshots that she had on her my client's cell phone led the Judge to make the correct decision," he argued.
The lawyer explained that compensation for "damages" was requested in addition to the cessation of publications.
"The judge cannot force someone not to do this if the person does not want to. But he can force them to pay compensation for moral damage caused to the honor, good name and dignity of my client," said Gómez Vélez. .
The exact compensation that the woman must pay is $12,800,000.
In the ruling issued this Tuesday, the judge argues that “it does not matter whether the accusations are real or not against the victim.
Under no circumstances can honor be undermined under any circumstances, since we are faced with a very personal right that must be protected.”
According to the newspaper El Litoral, the victim is dedicated to the commercial sector and the permanent denigration of his ex-wife
