 The outcry against the introduction of psycho-aptitude tests is growing in the world of the judiciary.

But there are already other measures on the minister's table for which further sparks will be announced soon with the robes union.

The next law on the separation of the careers of magistrates (judge and prosecutor) "will be presented by the end of April, at the latest in May - assures Nordio - and will be consubstantial with the reform of the Superior Council of the Judiciary for obvious reasons, so there will be two CSM separated."

It will be "a radical reform for which the Constitution must be changed and the process will obviously be longer".

Not only.

"Even with regards to the Severino law - reflects the Keeper of the Seals - we believe that a fine-tuning is necessary. It is not on the agenda but it is certainly part of our interest".


Measures that the ANM will hardly be able to digest while now the controversies over the tests are still taking center stage.


After protests from the National Association of Magistrates, among the first to speak out in this sense is the prosecutor of Naples, Nicola Gratteri, who comments: "If we want to do those tests, they should be done for all the top sectors of the public administration, for those who have government responsibilities and those who deal with the management of public affairs".

A provision which Gratteri would also add to the drug and alcohol test, because, he explains, "those under the influence of drugs can not only make altered reasoning but can also be blackmailed".


Pungent words to which the deputy prime minister and minister Antonio Tajani responds seraphically: "For me, if they want to do them, politicians can do them too. I've done a lot of tests, I've been an Air Force officer, I've never felt harmed in my dignity. Indeed, if they discovered something about me it would be better, they would do me a favor."

The number one of the Farnesina defined as incomprehensible "so much agitation" over the provision that introduces this verification for aspiring robbers and adds: "I don't find it offensive at all nor a violation of the autonomy of the judiciary. If the women and men of the police do it I don't understand why the person in charge of the judicial police can't do them."

Even if its president, Giuseppe Santalucia, clarifies: "It is a law that will come into force from 2026, we have plenty of time to convince that it is of no use in this way".

The number one of the ANM, replying to the Keeper of the Seals Nordio, who after the Council of Ministers had said that prosecutors and judges would adapt to a practice already foreseen for various categories that "have people's lives in their hands", underlined: "There there are many who don't take the test. We are not the only judiciary in the country, but we are the only judiciary that has all this attention from the government, the others don't have it."

Furthermore, "dispensation for mental illness has existed in our system since time immemorial. If there are cases of pathological imbalance, action is already taken. If we then want to control something other than the psychological pathology, but the way of being, the expression of a personality you don't like, this is arbitrary."
