This was said by the Austrian Transport Minister, Leonore Gewessler, speaking to the Apa agency at the end of the first hearing before the European Commission on Italy's appeal against Austria for the blockades at the Brenner pass. “We presented a new broad argument during the oral hearing in Brussels,” the Green politician explained, adding that “the lives and health of Tyroleans are non-negotiable.”
The legal process of the EU infringement procedure launched by Italy against Austria for the unilateral bans imposed on trucks at Brenner has begun. According to what we learn in Brussels, the first cross-examination hearing before the European Commission took place today.
The EU executive does not intend to make any statements as it is "a legally bound procedure". The procedure for dragging Austria before the EU Court of Justice, recalls a Commission spokesperson, is regulated by Article 259 of the Treaties. After the appeal presented by the Italian government, both parties now have the opportunity to present their arguments both orally and in writing before the EU executive which will then have to draw up - by 15 May - a reasoned opinion. In the event that Brussels does not act within that deadline, the Italian government will be able to appeal directly to the European Court of Justice.
