(CNN Spanish) - Former president of Peru Alejandro Toledo will remain in jail, at least for now, after the federal court magistrate in San Francisco, Thomas Hixson, said Thursday during the bond appeal hearing that he wants the prosecution presents alternatives for not having the ex-president in confinement.

According to the judge, this extradition process could last for years and that could endanger Toledo's health.

The prosecution responded that it will meet with the US Sheriffs Service. to explore what other possibilities exist for not having it under confinement, since keeping it together with the rest of the presidential population is not an option, for its safety, said the magistrate.

The judge cited both parties for this September 12, and that is when he is expected to make a decision on the appeal of the bond.

Toledo was arrested on July 16 at his residence in the San Francisco area, following the extradition order presented by the Peruvian justice to answer for the charges against him, which include corruption and money laundering.

For its part, the legal defense of the ex-plaintiff alleges that they have presented sufficient evidence to demonstrate that in the case of Toledo there would be alleged political persecution against him.
