Justice of Ecuador changes the crime for investigating Ola Bini, friend of Julian Assange

(CNN Spanish) - Unauthorized access to computer systems is the new crime for which Ecuador's justice investigates Swedish programmer Ola Bini, friend of Julian Assange.

The substantive judge of the case, Yadira Proaño, thus accepted the request of the Prosecutor to restate charges against Bini for considering that it is the one that best suits the criminal type for which it is investigated.

The Office of the Prosecutor, during the presentation of its arguments, insisted that Ola Bini tried to enter without authorization in 2015 the system of the National Telecommunications Corporation of Ecuador, which in turn was interconnected with the state-owned company Petroecuador and the former National Secretariat of Intelligence . The Prosecutor's Office relied on a photo found on Ola Bini's cell phone that would reflect "unauthorized access or use," which is considered a "criminal act."

Carlos Soria, Ola Bini's lawyer, said the defense will do everything possible to prove that there was no breach of computer systems. In addition, he said that the Prosecutor's Office shows that he does not understand well about technological issues. “There is total ignorance and not even the prosecutor knows what he was investigating. Why did the National Telecommunications Corporation not report if there was a breach of securities? Why didn't he report it in 2015? ”He said.

Soria insisted that the accusation against Bini is part of a persecution.

During the hearing, the lawyer insisted that the prosecution made allegations of a political nature and without adherence to the law. He added that Bini has not been treated equally before the law and that his right to due process has been violated.

According to the Prosecutor's Office, the evidence collected in the fiscal investigation opened since April 12 for alleged participation in the crime of "attack on the integrity of computer systems" are the same.

Considers that by principle of congruence, the Prosecutor asked to change the criminal type of "attack on computer systems" for "non-consensual access to computer systems." Both crimes are punishable by imprisonment for three to five years, according to the Comprehensive Criminal Code of Ecuador.
