Government of Guatemala can negotiate with the US be third safe country, resolves the Constitutional Court

(CNN Spanish) - The Constitutional Court of Guatemala announced Tuesday that it revoked the provisional protection that suspended the entry into force of the immigration agreement with the United States.

The high court declared “with place” the request for revocation of provisional protection made by President Jimmy Morales, who “holds the constitutional power to direct international politics and relations,” indicates the text published by the CC.

With this, the CC allows continuing negotiations with the United States. Constitutional magistrates state that the corresponding legal procedure must be followed. That is, the Third Safe Country agreement must be ratified by the Guatemalan Congress.

The Constitutional Court of Guatemala had granted a provisional injunction on July 14 that ruled that President Jimmy Morales should comply with the provisions of article 171 of the Constitution to constitute the territory as a "safe third country."

Such an agreement would require migrants who pass through Guatemala to apply for asylum in that country, instead of continuing to the United States. This would probably have the effect of preventing some immigrants from reaching the United States to seek refuge.
