(CNN Spanish) - The team of prosecutors who make up the Jato Java Operation Task Force in São Paulo denounced former President Luiz Inacio Lula da Silva and his brother, Frei Chico, on Monday for passive corruption.

The owners of the construction company Odebrecht, Emilio and Marcelo Odebrecht, have also been reported for active corruption, according to Agencia Brasil.

The Public Ministry maintains that between 2003 and 2015 Odebrecht paid monthly payments to Frei Chico, which in total would add 1.13 million reais (about $ 276,000).

According to the complaint, in exchange for these payments, Lula would have benefited the construction company from its position of president and later as former president with great influence in the Government of Dilma Rousseff.

Lula is currently serving a sentence of eight years and ten months in prison for corruption and money laundering for allegedly having benefited from a triplex apartment offered by another large construction company.

Lula's defense has once again denied the accusations and has ensured that the former president never offered Odebrecht any irregular benefits package.
