(CNN) - The Supreme Court cleared the way for the Trump administration rule that dramatically limits the ability of Central American migrants to apply for asylum to enter into force throughout the country while the appeals process is taking place.
Wednesday's order is a victory for the Trump administration, who argued that the rule was necessary to rule out "asylum seekers who refused to request protection at the first opportunity."
The rule, from the departments of Justice and National Security, would prohibit migrants who have resided or traveled through third countries requesting asylum in the US. Therefore, it prohibits migrants traveling through Mexico from seeking asylum.
Judges Sonia Sotomayor and Ruth Bader Ginsburg noted their dissent. Five judges were needed to grant the request; the votes of others were not announced publicly.
"Once again, the Executive Branch issued a rule that seeks to nullify long-standing practices regarding refugees seeking refuge from persecution," Sotomayor wrote, along with Ginsburg, and then referred to "some of the most vulnerable people of the western hemisphere ”.
“Although this nation has kept its door open for a long time to refugees, and although what is at stake for asylum seekers could not be greater, the Government implemented its rule without first giving public notice and inviting public opinion that generally required, ”added Sotomayor.
