They order the release of former president of Peru Alejandro Toledo

(CNN Spanish) - This Thursday a federal judge in California ordered the release of former president of Peru Alejandro Toledo although he immediately suspended the measure in case the government decides to appeal the decision.

According to the court document to which CNN agreed, Judge Vince Chhabria argued that given the circumstances of solitary confinement of Toledo, the psychiatric staff of the Santa Rita prison reported that “the detention under these circumstances has already initiated a marked decline in the mental health of Toledo ”.

For the judge, the combination of the long duration of the process and the conditions of confinement of Toledo create a “special circumstance” that qualifies the former president to be released on bail. In any case, the release order will be suspended until Tuesday, October 22, to give the Government time to appeal the decision or to propose an alternative measure of solitary confinement.

If the Government takes one of these two routes, the suspension of the order of freedom would extend until October 29. If the Government does not act, according to the document, then Toledo should be released on October 22.

The former president was arrested on July 16 at his residence in the San Francisco area, following the extradition order presented by the Peruvian justice to answer for the charges against him, which include corruption and money laundering. Toledo denies the charges.
