(CNN Spanish) - Alejandro Toledo, former president of Peru, could be released on bail at the end of October or mid-November if the United States government does not respond to the judicial request to modify the conditions of detention of the ex-president, as it emerged on Thursday at a hearing in the Court of the Northern District of California, in San Francisco.

In the session to review the status of the case, federal judge Thomas Hixson established October 22 and 29 as tentative dates for a hearing.
with the prosecutor and the public defender of Toledo, in which he should make a decision on the location that another judge of the same Court, Vince Chhabria, made to the federal government.

Chhabria, at the October 9 hearing, gave the government until 22 this month to look for other prison alternatives for Toledo, in
in particular, with conditions that avoid putting your mental and physical health at risk while the extradition process to Peru is being carried out.

Toledo has been detained in solitary confinement since he was arrested on July 16 at his residence in the San Francisco area.

The Peruvian justice filed an extradition order against Toledo to respond to allegations of corruption in the Odebrecht case. The defense of
Toledo says he has presented enough evidence to prove that there is a political persecution against his client, and that there are no accusations against him in connection with the Odebrecht case.

Thursday's hearing with Judge Hixson brought together ex-officio Toledo's lawyer Graham Archer and the prosecutor in the case, Elise LaPunzina.

LaPunzina said during the hearing that his office plans to file a motion before October 21 related to Judge Chhabria's decision.

As part of that decision, Chhabria added that he was willing to extend the deadline to the federal government until October 29 to determine if
He complied with his request. Otherwise, he warned, he would consider leaving Toledo free on bail.

According to lawyer Archer, his client is being held in solitary confinement in a San Mateo County jail, to which he was transferred from
a Alameda County jail.

Judge Hixson said Thursday that another possible date for a hearing with the parties was November 14.

Hixson asked the prosecution to stop using agents of the US Marshals Service to ask former president Toledo about his
health condition. And he asked that instead the prosecution be the one to do it directly.

Judge Hixson made that decision after Toledo's defense complained in court that the bailiffs were being used by the prosecution
as intermediaries
