(CNN) - A Barcelona court acquitted five young people of the sexual abuse of a child who was unconscious at the time of the attack after using alcohol and drugs at a party in 2016.
In its ruling, the court said that because the victim did not defend himself, the crime was not considered a violent act; therefore, men were found guilty of a minor charge of sexual abuse.
Five people have been sentenced to 10 to 12 years in prison.
In defending his verdict that the crime did not justify the most serious conviction of sexual assault, a statement from the Barcelona court said: "The court considers it unequivocally a crime of sexual abuse because" the victim has been proven, while the events took place and from the previous moment until hours after what happened, he was in a state of unconsciousness, without knowing what was done or not done, consequently, unable to determine and accept or oppose the sexual relations maintained with the defendants, who could perform sexual acts without using any type of violence or intimidation. ”

The case dates back to 2016 when a group of young people in the city of Manresa went to an abandoned factory to celebrate a “bottles” party.
