The Independent Commission Against Corruption today (26) sued a director of a consultant company and a director of an engineering company against them for allegedly conspiring to defraud their project developer of more than 23 million yuan in connection with the installation of a water supply installation for a hotel reconstruction project in Mong Kok.
The two defendants were 64-year-old director of Pingjie Co., Ltd. Wang Yongjiu, and 50-year-old director of Ocean Engineering Co., Ltd. Ma Xiuqin. They were charged with one count of conspiracy to defraud, a violation of common law, and the two will appear in the West Kowloon Magistracy on Thursday (28) pending a referral of the case to the District Court.
The ICAC received a corruption complaint earlier, and the investigation revealed the suspected crime. At the time of the case, Wang Yong was the sole director and shareholder of Ping Jie, an electromechanical engineering consulting company. Ma Xiuqin is an employee of another company that shares offices with Pinjie. At the same time, Ma Xiuqin and Wang Yongqin are both directors and shareholders of engineering company Oceanwide.
Creative Ideas Limited is a project developer for a hotel redevelopment project in Mong Kok. Chuangyisheng appointed Ping Jie as the project's electromechanical engineering consultant in March 2011 to provide consulting services on fire protection installations, electrical installations, mechanical ventilation and air conditioning installations, and water supply and drainage installations.
The charges include that Wang Yongjiu and Ma Xiuqin were suspected of conspiring to defraud the creative company when Pinjie was a creative company consultant from January 25, 2014 to April 11, 2016, and dishonestly did not report to the company Either disclose it or conceal it from Wang Yong's rights and relationships with Fanhai. Wang Yongjiu and Ma Xiuqin were suspected to induce Chuangsheng to invite Oceanwide to tender for the four areas of the project and to consider bidding for Oceanwide; leading Chuangsheng to award Oceanwide for the project's water supply and drainage installation.
The ICAC's investigation found that the total quotation of tenders for the four areas of the project in Oceanwide was more than 103 million yuan, and the contract awarded to Oceanwide's water supply and drainage installation project amounted to more than 23 million yuan. The two defendants have been granted bail by the ICAC pending a hearing on Thursday.
