DAMASCUS, (SANA) -President Bashar al-Assad issued on Thursday the law No. 25 of 2019 to determine the budget allocations


Damascus-Sana

President Bashar al-Assad issued today Law No. 25 of 2019, which sets the state budget allocations for the fiscal year 2020 with a total amount of 4000 billion Syrian pounds distributed on sections, branches and doors, as stated in the table of expenditure estimates accompanying this law.

The law reads as follows:

Law No. 25

President of the Republic

Based on the provisions of the Constitution.

And approved by the People's Assembly in its meeting held on 29-3-1441 Hijri corresponding to 26-11-2019 AD.

Issues the following:

Article / 1 /:

Appropriations of the state budget for the fiscal year 2020 shall be determined by a total amount of 4000 billion SP only four thousand billion Syrian pounds, not distributed among sections, branches and doors, as stated in the table of expenditure estimates accompanying this law.

Article / 2 /:

Estimated revenues of the state budget for fiscal year 2020 at a total amount of 4000 billion SP only four thousand billion Syrian pounds only according to the schedule of revenues attached to this law.

Article / 3 /:

The budgets of the public entities of an economic and structural nature shall be issued by a decision of the Minister of Finance after the issuance of this law, in which the share of the Public Debt Fund, the Corporation and the Company shall be determined from the estimated budget surplus.

Article / 4 /:

Funds allocated to the contribution of the State in fixing prices - social support - allocated:

A / To the Agricultural Production Support Fund by a decision of the Minister of Finance and by liquidation and disbursement orders issued by the Minister of Agriculture and Agrarian Reform.

B) The National Fund for Social Aid shall be issued by a decision of the Minister of Finance and by liquidation and disbursement orders issued by the Minister of Social Affairs and Labor.

C / To support the ration flour by a decision of the Minister of Finance and under liquidation and disbursement orders signed by him.

D / To support oil derivatives by a decision of the Minister of Finance and under liquidation and disbursement orders signed by him.

Article / 5 /:

The appropriations for working capital shall be paid to public entities of an economic nature by a decision of the Minister of Finance and by liquidation and disbursement orders signed by him.

Article / 6 /:

A / Exempt from the laws and regulations in force for some public bodies of an administrative nature that are considered independent accounting units and are linked to the state budget according to the principle of "subsidies". The budgets of these units have been reflected in the general budget of the state in full estimates of their expenditures and revenues without affecting the collection of their revenues. And disbursement of its expenses in accordance with its instruments of creation.

B) The Minister of Finance shall issue decisions after the issuance of this law specifying the amounts of subsidies allocated to these entities, ie, “the difference between the estimates of their revenues and expenditures” and shall be transferred to their entities on a quarterly basis.

C / The transfers of the current appropriations between the sections, items and paragraphs of these entities shall be issued by a decision of the Minister of Finance.

Article / 7 /:

The appropriations allocated in Section 014 shall be paid to retirees' salaries and pensions to pay the corresponding share and treasury obligations of the beneficiaries of the pension beneficiaries “civilians and their heirs… military and their families” under liquidation and disbursement orders issued by the Minister of Finance.

Article / 8 /:

(A) Postage, telephone, electricity and water consumption shall be considered as compulsory expenses and may not be transferred from them and shall be disbursed within a period not exceeding five days from the date of submission of the relevant exchange documents.

(B) The Minister of Finance may activate the accounts of the debtors for the purposes specified in paragraph (a) equivalent to the obligations incurred thereto.

The provisions of paragraphs (a) and (b) of this Article shall apply to ministries, public administrations, public bodies, local administration units, municipalities, Waqf departments and public entities of an economic and structural nature.

Article / 9 /:

(A) The salaries and wages of persons transferred from one governorate to another shall not be used unless the appropriations are redistributed by a decision of the Minister of Finance on the proposal of the Minister of Local Administration and Environment.

B / may not transfer from the allocations allocated to the directorates of education in the budgets of local councils to other departments of the provincial council or to other public bodies.

Article / 10 /:

Advances from ready treasury funds shall be repaid in 2019 and before to the public bodies of an administrative nature based on legal provisions in force under liquidation and disbursement orders calculated on the savings of the sections and branches of the general budget for 2020 after the approval of the Minister of Finance.

B / By the decision of the President of the Supreme Council for Planning, based on the proposal of the Minister of Finance to increase the appropriations of investment projects for 2020 to repay the advances granted from the ready treasury funds based on legal provisions in force in 2019 and before, provided that this increase is covered by the savings of other sections and branches of the general budget 2020.

Article / 11 /

(A) Public entities of an economic and construction nature shall maintain the estimated liquidity surplus to be used for financing replacement and renovation projects and part of their investment projects in the light of the appropriations allocated in the general budget of the State.

B) Public entities of an economic and structural nature shall finance their investment projects, which are allocated in the third chapter of the state budget by loans and loans.

(C) The Public Debt Fund shall grant loans to public entities of an economic nature to finance their investment projects, which are appropriated in Chapter 3 of the State Budget according to its financial capabilities.

D) Public entities of an economic and construction nature shall be allowed to borrow from public banks to finance their investment projects, which are allocated in the third chapter of the state budget.

(E) The funds specified in accordance with the provisions of this Article may only be used for the purpose allocated to them.

Article / 12 /

All public entities whose public investment funds are financed by the Public Debt Fund shall draw up a time plan distributed over the months of the year and send it to the Public Debt Fund within one month from the date of issuance of this Law, specifying in particular the estimates of investment spending according to the model adopted by the Ministry of Finance.

Article / 13 /:

(A) All public entities of an economic and structural nature shall supply the public debt fund's share of the budget surplus specified in the estimates stated in the State General Budget.

B- The supplies mentioned in the previous paragraph shall be determined according to a time plan distributed over the months of the year set by the above authorities and sent to the Ministry of Finance within one month from the date of issuance of this law.

Article / 14 /:

A / The competent minister or his equivalents shall, by virtue of a decision, pay incentive rewards within the credit allocated to the employees of his ministry or other budgetary appropriations of his ministry up to an amount not exceeding one million and eight hundred thousand Syrian pounds, and the issuance of incentive bonuses within the appropriation up to an amount not exceeding five hundred thousand Syrian pounds for rewards. Workers in each public sector or a public sector company under its supervision shall have a budget exceeding five million Syrian Pounds from the budgetary allocations of that body or other employees in the State.

B) To the Chairman of the Executive Office of the Provincial Council or his equivalents, and by virtue of a decision to pay them incentives to local authorities within the allocation allocated for remuneration for workers in the directorates of the provincial council or directorates of local bodies or other workers in other public bodies up to an amount not exceeding five hundred thousand Syrian pounds In each of the directorates of local bodies of the funds allocated for this purpose and the disbursement of a similar amount to the workers in each of the city councils, countries and municipalities of the provincial council or other workers in other public bodies whose budget exceeds five million SP from the national budget.

(C) The remuneration referred to in the preceding two paragraphs of the appropriations set forth in the remuneration line shall be disbursed from the budget of the Ministry, the Public Authority, the Institution, the Company or the Establishment.

D) The bonuses shall be paid quarterly from the amount specified in paragraphs (a) and (b) plus the balance of unspent appropriations during the previous months of the year.

E) The amounts disbursed under the provisions of this Article shall be excluded from the maximum limits of compensation and remuneration provided for in the laws and regulations in force.

Article / 15 /:

Provisions for the incentive bonuses allocated in the State General Budget for 2020 to members of the teaching staff who are studying in Syrian universities and their branches in the governorates, in addition to teaching in their original universities, including full-time students, shall be paid as follows:

- Not exceeding the amount of seventy million Syrian pounds for the University of Damascus.

/ Not exceeding the amount of fifteen million Syrian pounds for the Euphrates University.

/ Not exceeding the amount of ten million Syrian pounds for each of the University / Tartus .. Hama.

/ Not exceeding the amount of six million Syrian pounds for each of the University / Aleppo .. Baath .. October.

And that from the budget of each of the universities mentioned.

The amounts disbursed under the provisions of this Article shall be excluded from the maximum limits of compensation and remuneration provided for in the laws and regulations in force.

Article / 16 /:

With the approval of the Prime Minister, bonuses shall be paid as follows:

A / Decisions issued by the Minister of Finance and the Chairman of the Planning and International Cooperation Authority, each in his capacity to those working in the preparation of the state budget, up to an amount not exceeding two million Syrian pounds for each side.

B / Decisions issued by the Minister of Finance for workers who contributed to the automation and printing of the state budget up to an amount not exceeding one million five hundred thousand Syrian pounds and from the allocations allocated for this purpose in the budget of the Ministry of Finance.

C / Decisions issued by the Minister of Local Administration and Environment up to an amount not exceeding six hundred thousand Syrian pounds for workers in the study and preparation of budgets of local councils and 300 thousand Syrian pounds for workers in investment budgets of local councils.

D / Resolutions issued by the Chairman of the Planning and International Cooperation Commission for workers in economic and social studies up to an amount not exceeding one million Syrian pounds.

E / Decisions issued by the Minister of Finance for workers in studies related to tax legislation and public finance up to an amount not exceeding one million and five hundred thousand Syrian pounds.

F / Decisions issued by the Minister of Agriculture and Agrarian Reform for workers in the field of agricultural scientific research and studies up to an amount not exceeding one million Syrian pounds.

G / Decisions issued by the Minister of Higher Education for workers in the field of scientific research and studies up to an amount not exceeding one million Syrian pounds.

H / Decisions issued by the Minister of Water Resources for workers in the field of scientific research and studies up to an amount not exceeding one million Syrian pounds.

I / Decisions issued by the Minister of Industry in the field of industrial scientific research and studies up to an amount not exceeding one million Syrian pounds.

J / Decisions issued by the Minister of Public Works and Housing on the proposal of the President of the Regional Planning Commission for workers in regional planning studies up to an amount not exceeding five hundred thousand Syrian pounds.

The amounts disbursed under the provisions of this Article shall be excluded from the maximum limits of compensation and remuneration provided for in the laws and regulations in force.

Article / 17 /:

Acting upon the approval of the Prime Minister by decisions issued by the Minister of Higher Education, incentive bonuses up to an amount not exceeding one million and two hundred thousand Syrian pounds from the appropriations of item / 18 / rewards allocated in the budget of the Ministry of Higher Education for 2020 for members of educational bodies, including full-time employees and university workers Institutes, graduate students and others who work to complete the admission of new students to universities and institutes and register them by computer for the academic year 2019-2020 The amounts disbursed under the provisions of this article are excluded from the maximum limits for compensation and rewards. Provided in the laws and regulations in force.

Article / 18 /:

Transfer or transfer to the various sections and branches of the budget transfer expenses allocated in section 113 / section / 11301 / / Presidency of the Council of Ministers / decisions issued by the Prime Minister.

Article / 19 /:

The budgets of the local administrative units, the waqf departments and the popular action shall be issued in accordance with the legal provisions in force.

Article / 20 /:

(A) The appropriations allocated in item (41) / (contributions to economic activity) shall be disbursed from Chapter 4 / Transfer Expenses / Branch / 19202 / / Public Debt / based on the approval of the Prime Minister and under liquidation and disbursement orders issued by the Minister of Finance.

B / The appropriations allocated in item (48) / other commitments for current operations / from Chapter IV / transfer expenses / branch / 19202 / / public debt / to the various sections, branches, sections and budget lines by decisions issued by the Minister of Finance based on the approval of the Prime Minister Commitments for the appointment of engineers and mandatory appointments. Commitments to appoint doctors, pharmacists and subsidies for the implementation of some projects in the governorates Equipment, supplies, materials and emergency expenses.

C / Disbursement of cash subsidies for displaced people in the province of Quneitra from the funds referred to in paragraph / b / of this article upon the approval of the Prime Minister under liquidation and disbursement orders issued by the Minister of Finance.

Article / 21 /:

The allocations allocated in section / 011 / reserve provisions for investment projects in the state budget for 2020 and added to the appropriations section III / investment projects .. Local resources / to various sections and branches of the general budget by decisions issued by the Prime Minister .. Chairman of the Supreme Council for Planning .. On the proposal of the Minister of Finance.

Article / 22 /:

A / The funds allocated for reconstruction and rehabilitation, which are set out in section 015 of the Public Debt Fund, shall be financed permanently and transferred to the account of the open committee at the Central Bank of Syria at the request of the Chairman of the Committee formed by the Prime Minister's decision No. / 49 / M. 7-2016 and its amendments.

(B) The Chairman of the said committee shall be an alimony contractor and an order for liquidation and disbursement.

(C) Economic and constructional public entities financed by the reconstruction and rehabilitation funds allocated in the State budget shall calculate annual depreciation premiums for long-term assets purchased from such funds.

Article / 23 /:

(A) transfers of appropriations for current operations between chapters, items and paragraphs of a single branch or section shall be made by a decision of the Minister of Finance on the proposal of the competent minister.

The transfers between the appropriations of the sections of the budgets of local authorities shall be made by a decision of the Minister of Finance on the proposal of the Minister of Local Administration and Environment.

B / transfers of funds allocated for investment operations between the items and paragraphs by a decision of the Minister of Finance on the proposal of the competent minister after coordination with the Planning and International Cooperation.

C / transfers of funds allocated for investment operations between branches and sections by a decision of the Prime Minister .. Chairman of the Supreme Council of Planning .. On the proposal of the Minister of Finance after coordination with the Planning and International Cooperation.

Article / 24 /:

It is not allowed to transfer from the appropriations in the field of external resources and add them to the appropriations in the field of local resources.

Article / 25 /:

The Public Debt Fund is allowed to grant the Public Housing Corporation an interest-free loan at a rate not exceeding 30% of the annual cost approved for the implementation of small housing units “Youth Housing”.

Article / 26 /:

The Public Debt Fund shall be allowed to grant the General Authority for Road Transport with interest-free loans during 2020 to finance its investment projects allocated to the State General Budget.

Article / 27 /:

Payment of treasury bonds placed in cash coverage against the cumulative deficits arising from the stabilization of prices and their interest and the previous cumulative deficits of the general budget of the State and its accrued and unpaid interest shall be deferred until 2020 and shall be paid in ten equal annual installments, the first of which shall begin on 1-10-2035.

Article / 28 /:

Exception from the provisions of Legislative Decree No. / 60 / of / 2007 /:

A / The Central Bank of Syria grants the Ministry of Finance / Public Debt Fund / loans and advances to pay the budget deficit and the deficit of the state budget for 2020.

B) The loans and advances granted under this law shall be added to the elements included in paragraphs 1/5 / of article 34 of the Central Bank of Syria Law and the Basic Monetary Law No. 23 of 2002 and its amendments.

Article / 29 /

The appropriations allocated to the Presidency of the Republic and the Ministry of Defense shall be allocated within the appropriations of the branch / 19202 / / Public Debt. These appropriations shall be placed at the beginning of the fiscal year / 2020 / at the disposal of each by virtue of a decision issued by the Minister of Finance specifying the section and branch.

Article / 30 /:

The current appropriations of the departments and departments of the Treasury, the tax information and the real estate departments of the State under the Ministry of Finance in the governorates shall be disbursed in accordance with the provisions of Legislative Decree No. 64 of 2010 with liquidation orders and disbursement from the budget of the General Authority for Taxes and Fees for 2020.

Article / 31 /:

The Minister of Finance shall issue the necessary instructions to implement the provisions of this law.

Article / 32 /:

This Law shall be published and shall come into force as from 1-1-2020.
