Photo: Shai Mechloff, Video Editing: Nir ChenThe Supreme Court (Tuesday) partially upheld the state's appeal and convicted Alon Hassan, chairman of the former Ashdod Port Workers Committee, for two fraudulent offenses and public employee breach, as well as two fraud and breach of trust in the corporation.
The decision states that in the relevant period, they would inoculate family, corporate and business relationships with Dana Logistics Ltd., which operated in the port area and provided various services to its customers.
The Supreme Court convicted Hassan unanimously of a fraud and breach of trust by a public servant and of a fraud and breach of trust in a corporation because in his cap as chairman of the staff, he issued minutes of the Ashdod Port Board of Directors and an internal audit report and handed them over to Dana. There is a clear conflict of interest between the interest of the port and the interest of Dana and its personal interest in the outcome of legal proceedings taken by Dana against the port.

In the majority opinion, Hassan should be convicted of fraud of a fraud and breach of trust by a public servant and of a fraud and breach of trust in the corporation, due to his involvement in the "scrap exporters" affair. This was due to his participation in his cap as chairman of the workers' committee at a meeting aimed at finding a solution to the port workers strike in 2011 and during which the junk loading of ships was stopped. At this meeting, a representative of the Dana company was present and among the judges there was a dispute as to whether she had already offered her services in charge of loading. The scrap, so that this work can be resumed.
The court emphasized that, while leaving Hassan's acquittal in some of the charges, the overall picture shows that Hassan often did to some extent in the port of Ashdod, and did not fear to interfere with many issues, even if these issues are uninteresting or more serious - that this intervention may be considered behavior inappropriate. Hassan, it was determined, followed the fine line separating criminal behavior from the one who is not, and although not found to be convicted in some of the criminal law charges, this does not constitute a position on their administrative-disciplinary standing.
