The Constitutional Court rejects Lombardy on mosques

'The freedom is limited' (ANSA)


Lombardy has unreasonably limited freedom of worship: this was established by the Consulta with a ruling concerning the spaces for mosques and other religious places. According to the Court, religious freedom guaranteed by Article 19 of the Constitution also includes freedom of worship and, with it, the right to have adequate space to actually exercise it. Therefore, when regulating the use of the territory, the legislator must take into account the need to respond to this need and cannot in any case obstruct the establishment of religious facilities. The Committee has accepted the questions raised by the Lombardy Regional Administrative Court and has annulled two provisions concerning the location of places of worship introduced in the Lombard urban planning discipline by the regional law of Lombardy n. 2 of 2015.
The censored norms ended up "determining a strong compression of religious freedom without there being any real interest in the good governance of the territory".
