Following the request of Roman Zadorov's attorney for a retrial, the prosecution appealed to the court to order an order requiring EK's medical file to be handed over to her

The State Attorney's Office on Wednesday asked the Supreme Court to issue an order requiring the transfer of AK's medical file, which, according to her ex-spouse, alleged the murder of the late Thair Radha, was previously investigated and released.

Attorney Yarom Halevi, a lawyer for Roman Zdorov, who is serving a life sentence for Radha's murder, filed a re-trial last October on the grounds that there was evidence that would change the picture in the case.

Now, the State Attorney's Office is seeking to place an order on the Center for Mental Health from a seed that will require the medical file to be reviewed. The Prosecutor's Office justifies her request that the documents be required to hear Attorney Halevy's request for a retrial and return her case to court.

"These materials were not in the applicant's hands, and she contacted the attorneys who represented the respondent at the time and asked whether their network would consent to the removal of medical confidentiality on the requested materials. The respondent's negligence responded in the negative," the request states.

The Prosecutor's Office further states that as part of Attorney Halevi's request for a retrial, he provided four documents from AK's medical record, including a memorandum written by a psychiatrist, a forced hospitalization order, a visit report, and another 2014 report.

"All these documents were unknown to the applicant or the police and so far were not in their hands," the prosecutor's office noted. "The applicant does not know how these documents, which are filed under medical secrecy, came from the respondent's medical file. The respondent's inquiry revealed that these documents were not transferred with her consent."

The Prosecutor's Office concluded the request on the grounds: "In order that you may examine these claims regarding the respondent's inpatient circumstances in 2014, and that the full picture regarding her mental state after June 2012 be in her opinion, seeking the examination of the hospital's medical record from the respondent's hospital."
