The judge emphasized that the three defendants should consider whether they were conspiring to commit the crime and also their intentions, so as to decide whether they should be ruled for murder, Crimes of manslaughter or assault resulting in bodily harm. The judge also reminded the jurors not to convict the defendants that they had fled to Taiwan and that they had convicted of the illegal handling of the corpse, and still have to make a judgment on what they did. The jury of 4 men and 3 women withdrew from the court at about 1:00 pm, and no ruling was reached in the evening. The judge told them to rest first and continue the discussion tomorrow.
Three defendants (from left to right): Zeng Xiangxin, Liu Xihao and Zhang Shanheng.
Consideration must be given to whether or not to commit the offence together
When the judge guided the jury, they said they needed to consider the three defendants: whether Zeng Xiangxin (30), Liu Xihao (24), and Zhang Shanheng (27) conspired to commit the crime, and whether he intended to kill the dead Zhang Wanli (hereinafter: Zhang), Or cause Zhang to be seriously injured.
If they consider them to be conspirators and have the intention, the jury will need to consider whether their actions have killed Zhang. If the jury believes that all of the above are true, the three defendants were convicted of murder.
If you have no intention of killing, consider manslaughter
The judge also stated that if the three defendants were found to be conspirators, but had no intention to kill Zhang or cause him serious physical harm, the jury should consider manslaughter.
If the three defendants are not considered to be conspirators, the intentions and actions of the individual defendants in the case still need to be considered. If the jury believes that the defendant had no intention but his illegal behavior caused Zhang to die, the individual defendant should be convicted of manslaughter.
The judge further stated that if the three defendants were deemed not to be accomplices, it was necessary to consider whether Zeng who had given an alcohol injection to Zhang in the case had any intention to cause serious injuries to Zhang's body through the alcohol injection. If he considers that he has done so, he should be found guilty of causing serious bodily harm to another person. If the jury believes that an injection of alcohol is not sufficient to cause serious injury, it considers the word "severe injury" absent: the offence of causing bodily harm.
[The Sarcophagus Hidden Corps] The second defendant accused two other defendants of injecting alcohol "wait for death soon"
[The sarcophagus hides the corpse] Xiao Cao heard the defendant once said: Adultery, predatory killing, arson, arson, owing to rape only
[Sarcophagus hidden corpse] The third defendant claimed that he had suggested that the confession of the confession should lead him to bear separate criminal responsibility.
Defendants may go to Taiwan because of handling corpses
However, if the jury accepted Zeng Xiangxin's testimony and was given an alcohol injection because of Liu's coercion, he should be acquitted. However, if the jury accepted Liu Xihao's confession and stated that during his entanglement with the third defendant Zhang Shanheng, Liu was at the bottom and could not do anything, he should be acquitted. If the jury accepts Zhang Shanheng's confession, he only separated Liu from the deceased during the entanglement, and he should also be acquitted.
The judge also reminded the jury that although the three defendants fled to Taiwan after the incident, they may have gone to Taiwan because they had processed the bodies. In addition, although the three defendants pleaded guilty to preventing the legal burial of corpses, the judge emphasized that they should not be convicted of murder, and the jury still needs to consider whether they conspired and committed in the case.
The three male defendants were Zeng Xiangxin (age 30), Liu Xihao (age 24) and Zhang Shanheng (age 27). They were charged with the murder of man Zhang Wanli (age 28) in an industrial unit in DAN6 in Tsuen Wan on March 4, 2016. In addition, the three defendants pleaded guilty to one count of preventing the legal burial of the body.
