Harassment by state: Supreme will decide Netanyahu's advisers against phone search

Edit: Saul Adam

The Supreme Court this morning (Sunday) appealed on the appeal of Prime Minister Advisers - Jonathan Orich, Ofer Golan, Israel Einhorn and Yossi Shalom - against the search of their cellular devices. Counselors are demanding not to allow the search, as part of the suspicion of harassing Shlomo Pilber, and for violating their rights, such as the fact that the initial search was done without a warrant and without the suspects being signed to a form explaining that they had the right to refuse the search.

The Tel Aviv District Court approved the search despite the violation of the rights of the suspects. The Supreme Court has also joined the process of the Bar and Public Defender's Office - which supports the position of the suspects.

"The court analyzed most clearly and ultimately found a balance. I found no error in the decision, and if the case came to my decision in the first place, I would decide so and on the same grounds," Judge Abraham Heyman reasoned in the district court's decision. "This is an investigative process. The investigators found that there was a reasonable suspicion of committing an offense, and a reasonable suspicion that mobile phones had essential material to conduct the investigation. The test is the probable suspicion test. The premise of this decision was that the investigators had to issue a warrant before the search."

An investigation into the affair began after several protesters arrived under the state of Pilver's home with speakers, from which the cries came out: "Momo Pilber, what did they do to you that you lied against the Prime Minister?" The activists loudly echoed an excerpt from an interview given by Pilber to the media before he signed an agreement with the state, in which he said he approved the Bezeq-Yiz merger according to professional procedures and opinions.
