The court heard that Huang Junyan was the senior pharmaceutical representative of Novartis Hong Kong at the time of the case and was responsible for selling prescription drugs produced by Novartis Hong Kong to clinics and hospitals. Huang Songsen is an operator of Kaijun Pharmacy, a client of Novartis Hong Kong.
Novartis Hong Kong maintains two price lists for each prescription drug, one for medical institutions and registered doctors, and the other for pharmacies. The price of the same drug in these two price lists may be different. In addition, Novartis Hong Kong offers price-benefit terms to registered doctors, that is, free extra boxes of medicines, which are more favorable than terms offered to pharmacies.
