Attorney General Avihai Mandelblit replied to the High Court on Thursday, instructing him to submit an opinion on the ability of Prime Minister Benjamin Netanyahu to form a government if he is elected in the March 2020 elections, arguing that the High Court should not answer this question until Have a hearing on the petition, or invalidate it outright.

In a statement sent by Mandelblit, through the State Attorney's Office, "the opinion is part of the remedies sought in the petition, and the court has not yet discussed these remedies, no matter whether it intends to discuss the issue on its merits."

The Court also added that "in these circumstances, and as long as no such decision has been reached, the Court considers that there is no legal basis for it to submit a position on its behalf to the merits of things, as the petitioners request, before holding a petition, and without issuing a probation order and then a total order. , When the very question of whether the Court should now discuss and decide on the issue at issue is in itself a weighty, complex and sensitive question, and should therefore be required at a preliminary and separate stage, before the petition is clarified. "

Subsequently, Mandelblit asked the High Court to dedicate the hearing on the petition, which is scheduled to be held on December 31, on whether to dismiss or dismiss the petition, adding that if the court decides that the petition should be heard, then it will state its position on the matter.

Recall, the Movement for Quality Government petitioned the Supreme Court after the indictments against Prime Minister Netanyahu, calling on him to determine that the prime minister could not form a government, even if the Likud saw him win the next election. The judges who will discuss the petition are President of the Supreme Court Esther Hayim, Vice President Hanan Meltzer and Supreme Judge Uzi Fogelman.

The fact that only three judges discuss such a precedent petition is considered an unusual event - as usually in such petitions seven and even nine judges are also discussed, the three judges are considered activist judges. Following the limited and activist lineup, a senior legal entity has accused animals of "choosing the vehicle to stop like it" in the petition.
