In the case, Liang Guoxiong was accused of contempt of stealing documents from Ma Shaoxiang, then deputy director of the Development Bureau, at a meeting of a legislative council discussing the Yokosu incident. However, when the case was heard in the West Kowloon Court, the magistrate considered that the relevant charges were not applicable to incumbent Legislative Council members and ruled that the charges were invalid. The Department of Justice refused and appealed.
