Mathematician Stefan Mendel, who managed to win the lottery time after time and left the country when he was charged with fraudulent offenses, will return to Israel after his sentence is revoked and will require a retrial.

Following the precedent decision to cancel his sentence 16 years later, mathematician Stefan Mendel announced that he would return to Israel demanding that he re-trial. Following his announcement, the prosecutor's office said it was ready to consider sentencing a 10-month prison sentence for service work, but Mendel refuses: "determined to do justice."

Stefan Mendel, 80, became famous for an algorithm that developed the "Lottery Secret" crackdown, through which he won the lottery no less than 14 times in several countries around the world.

During the 1990s Mendel operated in Israel in the field of investment, and in 2002, after an investigation against him, Stefan Mendel left the country. He has since resided on Bonato Island in the Pacific.

In 2004, Mendel was convicted and he was sentenced to 10 months imprisonment and fined NIS 100,000 for fraudulent offenses and "failure to publish a prospectus."

About two years ago, Mendel petitioned Haggaz through his lawyer, Alon Eisenberg, demanding that the sentence be revoked and open for retrial. Last summer, in an unprecedented move, Supreme Court Justice Hanan Meltzer accepted the petition, canceled the sentencing and invited Mendel to come to Israel and apply for a retrial. "Imposing the sentence of imprisonment is wrong," the judge wrote.

Mendel recently announced his intention to come to Israel and claim his rights, purchased airline tickets and is scheduled to land in Israel on April 21, 2020.

Following his announcement, the prosecutor's office decided to propose an arrangement whereby the imprisonment sentence would be converted into service work. "Your recent proposal to close the case without penalty was reviewed by the relevant officials, including the Criminal and Deputy Director of the State Attorney Mommy Lamberger and Liat Ben Ari - and rejected," his statement said.

"Our proposal to convert the imprisonment sentence sentenced to imprisonment for serving in public service work - stands still. So does the proposal to opt out (only) of sentencing and openly claim the sentence."

The prosecution, it seems, would prefer to avoid having a retrial. Mendel, for his part, rejects the suggestion and stated through attorney Alon Eisenberg that "Following the precedent decision to cancel the sentence after 16 years, Stefan Mendel returns to Israel with new and shaky evidence, determined to reopen his trial and do justice."
