The Supreme Court ordered the release of Michael (Mickey) Illouz from prison today. He was jailed for 75 days, in a very rare prison sentence due to court disgrace, as part of a company dissolution process. The case was first published in Walla! NEWS.

This is a supermarket chain that was active in the north and south, and went into liquidation in 2016. The special director appointed by the Nazareth District Court, Attorney Adi Gila Hachmon, concluded that the company allegedly collapsed due to a stinging exercise carried out by the owner along with one of the senior executives, who is the son of Illouz. And took away the computers used by the bookkeeping department - including supposedly valuable information.

Nazareth District Court Judge Arafat Taha ordered Illouz to return the computers - and about two and a half months ago, even sent him to prison until he did, or he said what happened. Illouz, a resident of the north in his 50s who will be represented in these proceedings by attorney Yuval Yoaz and Doron Barkat of the Cranial & Co. office, still denies that he took the computers, so he cannot answer them.

The Supreme Court has previously ruled on the proceeding, but approved sending Illouz to jail, stating that his detention should be reapproved every 21 days. Today, Judges Yitzhak Amit, Noam Solberg and George Read decided that the sentence was exhausting.

"For my taste," wrote Justice Amit. "In exceptional cases like the one before us, when the conversion claim for inability to comply with the order is a claim that can be raised on the practical level (as opposed to the legal level), but especially when the sanction imposed on the conversion involves imprisonment and violation of the right to liberty, then weight must be attributed to the time when the conversion is given Under the sanction sword. "

Judge Amit went on to say that "in the case before us, we are standing in the fourth prison term, and after the respondent has run for about half the period." He stated that "at this point in time, I do not see a continuation of the imprisonment, given the slim chance that this would bring" appellant "to the appellant, and to admit that the computers are still under his control or that he has destroyed them." He ordered Illouz release from prison.
