The Commission accepted the Attorney General's position and applied additional considerations, under section 10 (a) of the probation release, which states, inter alia, that "the release of the prisoner will severely impair public trust, the judiciary, law enforcement and many deterrence."

The committee's decision stated that "this is a case where there are special circumstances of a serious criminal past in which the prisoner displayed carelessness, high negligence and lack of empathy for his victims, and repeatedly jeopardized the public on the grounds of past offenses committed by him. The commission believes that the 4-year period that remains for a prisoner to serve is a long period of time, which results in an unreasonable relationship between the severity of the prisoner's offenses, their circumstances and the sentence he is sentenced to, and his term of imprisonment if he is released today, ie after 7 years in prison.
