Error allowed the first gay marriage in Costa Rica

(CNN Spanish) - The Notarial Court of Costa Rica on Monday ordered the dissolution of a marriage between two women after documenting that one of them was registered by mistake under the male gender, according to the Civil Registry of that country.

That mistake was precisely what made civil union between the two possible in 2015, when same-sex marriage was prohibited.

The Court also ordered the suspension of the professional exercise for almost 15 years of the notary who celebrated the union, Marco Castillo, who told CNN that the decision to annul it is due to “repressive, discriminatory, prejudiced and that violates human rights”.

Contacted by CNN, the couple said they will not offer statements until speaking with their legal representatives.

In Costa Rica, same-sex marriage was approved in 2018 and will enter into force from May 27, 2020, when the 18-month period given by the Constitutional Chamber to repeal the articles that refer to the prohibition ends .
