The national government clarified on Monday that the benefit of double compensation in case of dismissal without cause does not reach public sector workers . He did it through the decree of necessity and urgency 156/2020 published in the Official Gazette.
As expressed among the recitals, the measure was taken based on “the situation that has arisen in the scope of different agencies and entities of the National Public Sector, in which senior managers with hierarchical responsibilities intend to be covered by the provisions of the rule ” .
Particularly, it refers to several officials designated by the macrismo that still remain in their positions and generated controversy with the Executive.
The double compensation was reinstated on December 13, three days after the assumption of Alberto Fernández, who declared the public emergency in occupational matters for 180 days with a DNU.
That resolution was almost a replica of the so-called "antidepid" law that Congress passed in 2016, promoted by truck driver Hugo Moyano and Peronism, which prohibited unjustified severance for six months and restored double compensation, but ended up being vetoed by former president Mauricio Macri.
The double compensation has a long history in the country. When in January 2002, during the government of Eduardo Duhalde and after the 2001 crisis, the Economic Emergency Law was passed, one of the measures included was double compensation. The rule was aimed at curbing mass layoffs at a critical time for the country, following the fall of the Fernando de la Rúa government.
The text established that employers should pay double compensation to employees dismissed without cause, in accordance with the provisions of the Labor Contract Law and the current agreements of each activity. Finally, that measure was repealed in 2007, at the end of Néstor Kirchner's term.
