Ciro Pertossi was the second of the rugbiers arrested for the crime of Fernando Báez Sosa (18) to sit down Wednesday before prosecutor Verónica Zamboni for the second investigation. And he maintained the same position as Máximo Thomsen : he refused to testify, he did not accept to answer questions, but that did not imply that he did not say some things.

Pertossi said that prosecutor Zamboni generates "distrust", and denounced that they are threatened by other prisoners in the Dolores prison, who tell them that they "can hurt them."

"I would declare but not in front of (prosecutor Veronica) Zamboni because it causes me distrust because I don't know if what I'm going to say here is going to be in the media, as it was already happening," said Ciro Pertossi.

And he continued: "All we want is for all this to end. We want to testify because we no longer bear the pressure of the media, of the prisoners who are threatening us every day."

Then he talked about the alleged threats in jail. "The inmates themselves tell us that they can hurt us," were the sayings of Ciro Pertossi, according to the Télam agency. He added: " All we have is fear that something might happen to us."

The words of Ciro Pertossi were in line with those of Thomsen, the first of the eight rugbiers to pass to face the second investigation against Zamboni: "You lied to my face, while you are the prosecutor I will not talk about the case," He had told the prosecutor.

And Thomsen also spoke of life in the Dolores prison: "The other prisoners shout at us that our heads are priceless (...), who want to rape us, shout at us all through the window."

Then, it was Blas Cinalli's turn. "We are all afraid, because of the issue of jail, things scream at the window, they tell us they are waiting for us ," he said.

Enzo Comelli also pointed out: "(In the prison) we receive many insults and threats from other inmates through windows at dawn, in the afternoon, at all times."

"They want to scare us by sharpening the tips under our window, shouting our last names repeatedly, recording videos waiting for us in the pavilions," he added.

The judicial situation

Thomsen and Ciro Pertossi were from the outset charged as co - authors of the crime of Fernando Báez Sosa, who died at dawn on January 18 after receiving a brutal beating at the exit of the bowling Le Brique de Villa Gesell .

But after Guarantees judge David Mancinelli endorsed the request for pretrial detention and added the aggravation of " alevosía " to the rating; and that the prosecutor extend the imputation to the eight as “co-authors” of the homicide, with the double aggravation of the alevosía and the premeditated contest of two or more people and the injuries suffered by the friends of the victim; the accused found themselves with a second chance of telling their version before the Justice.

In addition to Ciro Pertossi and Thomsen, Blas Cinalli, Enzo Comelli, Ayrton Viollaz, Luciano and Lucas Pertossi and Matías Benicelli were also charged by co-authors when they had previously been accused of being necessary participants in Fernando's crime.

Therefore, this Wednesday the eight were transferred to the prosecutor of Villa Gesell to be investigated under the new complaint. "We do not know why we are detained," was the approach repeated by the rugbiers, in front of the prosecutor and in the presence of Judge Mancinelli, who arrived at noon at the request of defense lawyer Hugo Tomei.

The position taken by the defendants follows the line of the arguments that the defense lawyer has been making, who criminally challenged and denounced the prosecutor for alleged irregularities that occurred the day he first investigated his clients.

The only ones who will continue to be accused as " necessary participants " will be Alejo Milanesi (19) and Juan Pedro Guarino (19), who recovered their freedom last Monday, February 10, and are expected to be investigated this Thursday.
