Pilarski case: DNA analyzes “too expensive” for justice

2020-02-20T19:35:45.179Z

100,000 euros - this is the amount proposed by a laboratory to analyze the DNA of dogs possibly involved in the death of Élisa Pilarski.

" Too expensive!" ", Exclaims justice when it discovers the estimate made to the investigators by a renowned Bordeaux laboratory. As part of the investigation into the mysterious circumstances of the death of Elisa Pilarski, justice has removed the saliva secretions from the 62 dogs of the "Passion Rally", and the 5 American Staffordshire of Christophe Ellul, the companion of the victim. On November 16, around 3 p.m. in the Retz forest, in Aisne, the latter had discovered the atrociously mutilated body of Elisa Pilarski, 29 years old.

After examining the seals, the forensic analysis laboratory headed in Bordeaux by Professor Christian Doutremepuich would have estimated its service at 200,000 euros for 350 analyzes mobilizing 20 people for two months. Enough to tickle the parquet floor of Soissons and the general parquet floor of Amiens, who must give their opinion on this thorny issue. Sent at the end of December, the estimate seems to be tight.

Faced with the cost deemed too high of the invoice sent to justice for the DNA analysis of the dogs involved, the investigating judge requested a new quote from a second laboratory. Without any guarantee that the price will be cheaper, and therefore that justice will accept, we must expect not to know the truth about the Pilarski case right away.

" My client can't understand why we don't put in place all the means to find the truth?" Why this slowness and why enter this cycle of immobilization with regard to these DNA analyzes? ", Indignant at Figaro Me Alexandre Novion, lawyer for Christophe Ellul. " He interprets it as a form of reversal against him because this announcement is to be put in perspective with this over-focus on his dog Curtis: we keep talking about his bites from before, according to ... My client sees it as a stigma as a victim, ”adds the companion's defender.

67 dogs involved, a second estimate in progress

Almost three months after the tragedy, the enigma surrounding the death of Elisa Pilarski therefore remains total. The young woman was probably killed by one or more dogs. The question is: which one (s)? The malinois encountered by the victim during his walk was quickly removed from the list of suspects. There remains the couple's dog, Curtis, and the dogs present during the hunt. A total of 67 dogs. Judicial information had then been opened against X for "manslaughter by clumsiness, recklessness, inattention, negligence or breach of an obligation of prudence or security imposed by law or by the regulations resulting from the assault committed by dogs" .

We take refuge behind DNA expertise. What do these analyzes demonstrate? Simply that there was contact between such and such a dog and the body of Elisa Pilarski. That's all, ”said Me Guillaume Demarcq, the lawyer for the hunter-crew crew Sébastien Van Den Berghe. " Finally, it is clear that these analyzes will reveal the DNA of his dog Curtis, since he was walking with Elisa ". Regarding hunting dogs, the penalist assures that, " if they had contact with her after her death, their DNA will also be present in the results, this is not excluded, but that does not will not put dogs in the hunt with hounds in question, one should not confer on DNA analysis a value which it does not have ”, underlines it.

The investigation should, he said, " go the old way ", focusing more on the testimony, the phone calls and the "transportation of the premises" which took place last Wednesday, February 12. " My client's depression is linked to the fact that the hunters put into perspective the contribution for the truth of these DNA expertises ", answers Me Novion.

Prosecutor's “silence” faced with an “irrational psychosis” surrounding the case

Without analyzes, the press gets carried away and impatient. Me Demarcq sketches a smile: “ All the professionals knew that having the results in February was impossible. We have the impression in this case that we need to know right away, that the investigation must be completed in 15 days and that DNA is the queen of evidence. Whereas it is a criminal case like any other: it takes time . ”

An appetite for the Pilarski affair which results in a sort of arbitrary "media justice", according to the representative of Sébastien Van Den Berghe. The cause ? Social networks, which, he says, fuel " a kind of disturbing conspiracy ". On Twitter and Facebook, the lawyer for the “Passion Rally” notes with dismay “ an astounding number ” of “ absurd ” theories: “ Anyway, we will never know the truth, and then the hunters are protected by Emmanuel Macron. .. ", can we read there, he says.

" With social networks, it becomes nonsense," sighs the specialist in criminal law. An “ irrational psychosis ” around a “ hyper-publicized ” dossier which, according to him, “is fueled by the online posts of Christophe Ellul ” and “ by the silence of the public prosecutor of Soissons ”, Frédéric Tinh: “ the longer it takes to communicate, the more it feeds conspiracy theses ”. " This is a completely irrational case, " insists Me Demarcq.

" I am flabbergasted that we are at a standstill, that these exams are not under way (...) Yes, it is expensive, but nothing beats a life ".

Me Alexandre Novion, lawyer for the victim's companion

Comparing the media treatment of the Pilarski case to the Dupont de Ligonnès case, Me Guillaume Demarcq notes, amazed, " the gap between the judicial file and what we see on the media ". The lawyer is said to have been speechless when he learns that the lawyer of the Curtis dog, Eric Alligné, specialist in animal law, was invited on the set of BFMTV, " while he does not have access to the folder ”. " A fine example of madness around this affair " according to him, where " we call on a person who does not know the file to speak about it ".
