[Wuhan Pneumonia] Court Closes Near Bar Association President Urges Government to "Find Numbers"

2020-02-24T12:49:08.689Z

In response to the "Wuhan pneumonia" epidemic caused by the new coronavirus, the judicial organs have postponed all general hearings since last 29th to deal with only urgent and necessary cases. As the court "closed" for nearly a month, both barristers and solicitors' incomes have dropped significantly. Some barristers have pointed out that because the courts currently operate only to a limited extent, new barristers may be "no monthly income". The Chairman of the Bar Association, Dai Qisi, wrote to the Department of Justice and the Legal Aid Department earlier, reminding the other party to "find" as soon as the court "stops" to pay the expenses of handling the legal aid case and serving as an external prosecutor.

Refers to case sharing

In a notice issued to members of the guild, Dai Qisi noted that many barristers had significantly reduced their income during this period. He pointed out that he had written to the Department of Justice and the Legal Aid Department to pay the fees that had not been paid to Dazi while taking advantage of the current "gap". In addition, Dai Qisi also told the Department of Justice that if the court reopened due to the accumulation of cases and lack of embankment, members of the guild could be employed as prosecutors to help share the case, so that the Department of Justice prosecutors can handle other urgent matters.

Dai Qisi also revealed that several members of the guild expressed concerns about the state of private practice when they met with the judiciary on Tuesday. He originally planned to talk about the impact of the epidemic on the livelihoods of members of the guild when meeting with the Legislative Council Panel on Judicial and Legal Affairs today, but the meeting was postponed indefinitely due to the epidemic.

New barristers in major criminal cases or `` no monthly income ''

Huang Yuyi, a barrister who handles most civil cases, said that the closure of the court in the past month has indeed affected his income, but "the rent has not been paid." He said that the impact on barristers engaged in criminal litigation may be greater, because most of their income comes from "going to court", and believes that the current situation may make barristers who are new to the field and engaged in criminal litigation "no income for a month."

Huang Dazhuang, who dealt with a prisoner cut case and a two-in-one appeal case, said that the two cases were originally scheduled for trial in February, but the two cases need to be rescheduled, but the court has not yet instructed the lawyer to provide a future Hearing day. He also revealed that he was informed that some judges had written to lawyer representatives to deal with hearings that could not be postponed.
