The dispute over a planned wooden house on a dream property on Lake Staffelsee turns into a film-like mud fight: A new decision by the municipal council leads to a criminal complaint.

Uffing– The reason that Karolin Finkbeiner belongs is one of the most beautiful Uffings. This location alone: From the boat hut you have a view of the mountains, Ester Mountains, Wetterstein, Ammergau Alps, and of course the Staffelsee, the Mühlwörth Island . Rupert Wintermeier, the mayor, affectionately calls Uffing the most beautiful community on Lake Staffelsee because of this view and teases the neighbors.
The Finkbeiner family wants to build a wooden house on this unique piece of earth. The committee already approved eleven months ago - with a mini majority (8: 7 votes). Now the councils are revising their decision (10: 5), do not draw up special statutes for the outside area south of Kirchtalstraße and are leaving a disappointed and angry Frithjof Finkbeiner.
Top property on Lake Staffelsee - Entrepreneurs: “Hollywood-style coup”
The entrepreneur, a member of the "Club of Rome" circle of experts, takes a counter strike. His accusation: With a "Hollywood-style coup" the community overturned the decision of March 14, 2019.
In the leading roles, he sees the two mayors, Wintermeier and deputy Josef Diepold (both WGU), who did not accept the decision of their council colleagues and worked in the background to correct the vote. "It's a huge mess," rumbles Finkbeiner.
Because of municipal council decision: Finkbeiner files a criminal complaint
The Uffinger filed a criminal complaint with the Murnau police inspection on Thursday evening against a local council, the name of which he had not yet learned. Because of defamation.
In a non-public meeting said mandate holder is said to have put on record that Finkbeiner is threatening him. Local councilor Wolfgang Hirschvogel (CSU / Citizens List) had casually mentioned the incident at the meeting on Wednesday. Hirschvogel did not reveal the name. Finkbeiner then initiated the procedure. Now Hirschvogel has to reveal the name to the police. "I've got it now. I am the first to be put in detention, ”complains the local council. Finkbeiner calls the situation uncomfortable. But he doesn't want to leave the accusation. "I have never threatened anyone in my life," he clarifies.

Instead, he speculates that the slander is part of a plan that is designed to prevent house building. Since the vote per special statute, and thus per building, the evidence for this has accumulated.
Finkbeiner describes his findings in detail on three pages in the criminal complaint that is on the daily gazette. The short version: Before the vote, both mayors are said to have intimidated the councilors. At a meeting of the electorate, Diepold is said to have put the Finkbeiner couple under pressure with the following statement:
"When a Finkbeiner comes to the municipal council, I quit."
Whereupon Karolin Finkbeiner withdrew her candidacy. In November, local boss Wintermeier, in a conversation with the Finkbeiners, refused to implement the decision, and shortly afterwards commissioned former district builder Bernd Feldpausch to do the planning.
With Feldpausch's help, Finkbeiner believes, Wintermeier has put the topic on the agenda and forced a new vote. Most recently, a letter from the district office reached him in early February. The community complains that his wife and two children illegally state and use the station that the Finkbeiners has restored as their residence. "It was tolerated until the wooden house was ready," he explains. The "slanderous poison", sprayed in the town council, has now worked and influenced a "democratic decision" in favor of the community. "My confidence in democracy is severely damaged."

Mayor Wintermeier counters the serious allegations with arguments - and a stubborn cynicism for which he is known. When asked why he had the point voted again, he replied: “Because the church can. Anyone [local council] can get smarter. ”The municipality had taken advice from the Bavarian Community Day. From the experts, Uffing received a clear recommendation to only approve buildings in the outside area as soon as there was public interest. "There is no interest from the community down there," emphasizes the village chief. He also refers to a judgment of the administrative court for the same area. A very old one from 1975. But nothing has changed in the situation to this day.
Proponents of the construction speak of a vacant lot
The proponents of the construction, however, speak of a vacant lot that should be closed. There is a house on the lake in the immediate vicinity of the property. This argument invalidated Diepold. "There is a gap in the development - but not a gap." By definition, there is no such thing in the outdoor area. The second mayor pointed out the areas across the street, north of Kirchtalstrasse. In 2014 the committee decided against building on these fillet pieces. Now “eight meters further to the right” create building rights: “I can't do that.” Ultimately, 9 of the 14 councilors and the mayor followed his argument.
Finkbeiners are considering leaving Uffing
Finkbeiner, his lawyer and the property neighbor then left the room. The couple will probably also leave Uffing and move to Mexico. "We are not welcome here," he says. He does not know whether his children will also withdraw the Plant-for-the-Planet Foundation, that is up to the youngsters. It is conceivable. "The children get a peace award and the community declares war." Doesn't match. In any case, they keep the fillet area by the lake. For taking a bath. Finkbeiner says: "I love Uffing." And adds.
