(CNN) - The newly convicted rapist Harvey Weinstein was supposed to be locked in the Rikers Island prison.

Instead, the former film magician is in a Manhattan hospital, a day after his convictions were known for first-degree criminal sex and third-degree rape.

The ambulance transporting Weinstein to Rikers Island on Monday was diverted to Bellevue Hospital due to heart palpitations and high blood pressure, said lawyer Donna Rotunno.

Weinstein remained in Bellevue Prison on Tuesday morning, the hospital said.

Although Weinstein "is fine," the 67-year-old man has "major medical problems," Rotunno said.

Another of his lawyers, Arthur Aidala, said he is strong and wants to keep fighting.

There are no updates on when Weinstein will go to the prison facilities in Rikers. He is insured, but not handcuffed to bed, according to Aidala. Weinstein is accompanied by his family, Aidala said.

The use of a walker throughout the trial generated speculation that he was faking an injury to gain sympathy.

But it was Weinstein's legal team who convinced him to use the walker for medical reasons, Rotunno said.

"We wanted him to use a walker last week, and Mr. Weinstein didn't want the press to think he was looking for sympathy," Rotunno said in December. "Have pain. He underwent surgery. ”

But that surgery "was unsuccessful," his lawyers told the court on Monday.

“He is currently under the care of five doctors. He is dealing with the consequences of his back operation that was unsuccessful. He needs the walker, ”said the defense team.

After Weinstein is released from Bellevue, he is expected to go to the Rikers Island correctional facility, a notorious prison complex that has been plagued with problems, while awaiting sentencing in March.

Most inmates at Rikers await trial or serve sentences of one year or less.

Aidala told CNN that her lawyers are working on bail pending sentencing and bail pending appeal, a two-pronged approach. They have not decided which path to choose.

Bail is the focus of the legal team at this time, not the judgment itself.

Weinstein had been released on bail during the trial.

Weinstein's conviction for a first-degree criminal sexual act carries a minimum penalty of five years in prison and a maximum of 25.

But Weinstein's criminal cases are not over. He also faces charges of sexual assault and rape in two separate incidents in Los Angeles.

Weinstein has denied accusations of non-consensual sexual activity related to those cases.

So far no hearings have been scheduled in California cases, the Los Angeles County District Attorney's Office said.
