Wolfratshausen - The case caused a sensation almost a year ago: in March 2019, a then 31-year-old Wolfratshauser was supposed to testify in a negotiation about a fight in a Farcheter playground. He relieved the 35-year-old defendant by making a surprising confession. The witness was the culprit himself. Now the warehouse clerk had to answer to the district court for willful bodily harm and property damage.

"Yes, that's right," the accused renewed his confession. On June 30, 2018, he first drank plenty of beer at a summer party and then stocked up with more drinks in a petrol station in Wolfratshausen. He then went to a playground around 10 p.m. to look for a friend. There he met a group of young people and promptly received an answer from a then 17-year-old student about where the missing friend could be. This presumption turned out to be wrong, however, after which the accused returned in a rage after about 25 minutes and slapped the pupil in the face and stomach several times. The victim's glasses were also damaged.

19 months later, the 32-year-old only wanted to remember two blows due to his drunk condition at the time. However, his victim and two other students testified that the man ran after the fleeing youth and struck at least four times. "A punch in the face of a person wearing glasses can be very dangerous," said Judge Friederike Kirschstein-Freund. Since there were already eleven entries in the criminal record of the perpetrator, the public prosecutor asked for a 14-month prison sentence for the accused. This included driving without a license, showing a fake driver's license and finding three grams of a prohibited narcotic in his apartment. These three facts occurred a good four months after the fight on the Wolfratshauser playground.

Judge Kirschstein-Freund was able to understand the prosecutor's application, but then decided on a one-year suspended sentence. "Without your surprising confession a year ago, it would have been difficult to identify you as a perpetrator," she said. As a requirement, the warehouse clerk has to pay 100 euros in damages for the bent glasses and 5000 euros to the Oberland workshops for people with disabilities.

Before the verdict, the accused took the opportunity to personally apologize to the student: "I am sorry, I am a different person today than I was then."
