Yuka application ordered to pay 3000 euros for denigrating canned goods

The very popular application that notes food, cosmetics ... and incidentally their packaging has been pinned by the courts.


It all started with the publication of an article on Yuka's blog. The application to the twelve million users published an article entitled "Stop food packaging". She was ordered to pay 3000 euros to the French Federation of Preserved Food Industries (Fiac). The summary judgment of the Commercial Court of Versailles, dated March 5, 2020, further ordered Yuka to remove the disputed passages, under penalty of € 500 per day of delay and per violation found.

The Fiac attacked Yuka, believing that the blog note made an amalgam between canned goods and aluminum. She suggested that cans would be impacted by the risk from aluminum. Enough to give cold sweats knowing that, according to the National Agency for Health Security, Food, Environment, Work (ANSES): " the toxic effects of aluminum mainly affect the central nervous system (encephalopathies, psychomotor disorders) and the bone. " However, Yuka reported that 80% of cans are made of tin and the remaining 20% ​​of cans that are made of aluminum are coated with a protective film.

The court therefore considered that “ the tone of the remarks contained in the blog lacks measure by an abusive generalization relating to all the packaging in which the food is kept; that the information transmitted by the disputed article also lacks a sufficient factual base, that it is based on a single source, which is wrongly cited and interpreted in an extensive manner ”. The application purely and simply removed the note from his blog.
