Coronavirus: new sanctions for non-compliance with confinement

In the event of four confinement violations within thirty days, the offender faces a fine of 3,700 euros and a maximum of six months in prison.


The National Assembly voted on Saturday, March 22, the article of the bill against the coronavirus allowing the establishment of a " state of health emergency ", with the addition of sanctions for non-compliance with confinement, including one possible prison sentence.

Adopted by a show of hands after several hours of discussion, the article provides that the state of health emergency, which allows public freedoms to be restricted (confinement, requisitions, etc.), must be instituted upon the entry into force of the law, and for two months in the case of coronavirus.

The text thus allows the government " as necessary " to take measures " limiting the freedom to come and go, the freedom to undertake and the freedom of assembly, for the sole purpose of ending the health disaster " . Raphaël Schellenberger (LR) predicted that this wouldanimate ” the discussions between the Assembly and the Senate on Sunday with a view to a compromise, because it offers “ colossal power to the government ”.

" You are asking us for a considerable effort ", abounded Charles de Courson (Liberties and Territories), while Boris Vallaud (PS) worried about " an absolutely infinite field of derogations from the rule of law ", Alexis Corbière (LFI) also deeming it " far too wide ". Coralie Dubost (LREM) recalled that it was a question of fighting against a virus which " prospers " faster than the debates in the Parliament. Jean-Christophe Lagarde (UDI-Agir) abounded, emphasizing the temporary nature of the regime.

Offense in the event of a repeat offense

Excluding the current coronavirus case, the text provides for a triggering of the state of health emergency by decree in the Council of Ministers for one month, the extension can only be authorized by law. Several elected officials argued that an opinion from the scientific council was required beforehand.

At the end of the debates on the article, the Minister of Justice Nicole Belloubet presented an amendment providing that the repeated violation of the rules of confinement constitutes an offense punishable by six months' imprisonment and a 3750 euro fine. Several elected officials considered it disproportionate, even " implausible " (LR).

After a further suspension of the session, the Keeper of the Seals presented a more consensual “ graduated ” formula: a fine of 135 euros in the event of a violation of the rules, 1500 euros in the event of recidivism “ within 15 days ” and in the case of " Four violations within thirty days " an offense " punished with a 3700 euro fine and a maximum of six months in prison ".
