They target Prime Minister Édouard Philippe, the former Minister of Health Agnès Buzyn, or his successor currently in office Olivier Véran. Five complaints against members of the government aimed at managing the Covid-19 epidemic have been received by the Court of Justice of the Republic (CJR).
The CJR, which Emmanuel Macron intends to suppress, is the only body empowered in France to judge acts committed by members of the government in the exercise of their functions.
The complainants accuse these members of the government, as the case may be, of endangering the lives of others, manslaughter, failure to assist persons in danger or of having failed to take timely action to contain the epidemic. The requests committee of the CJR must now rule on the admissibility of these complaints.
Among the complaints is however not that of three doctors, representatives of a group of caregivers, which had been announced Thursday. According to the judicial source, it has still not reached the complaints commission of the CJR.
"Obstruction of assistance measures"
A sixth complaint for “obstructing assistance measures” targeting Agnès Buzyn and Édouard Philippe is on its way to the Court of Justice of the Republic, according to FranceInfo. It was filed by a 46-year-old Parisian infected with Covid-19 for "obstructing assistance measures", Tuesday according to BFM-TV. On March 13, the complainant was "taken with a feverish thrust", had a sore throat and was coughing. A doctor who came to his home confirmed his fears: he was diagnosed with the new coronavirus.
Due to a lack of beds, the patient could not be hospitalized and his state of health has "deteriorated considerably" for ten days, according to his lawyer Maître Nabil Boudi. He wants to see the opening of an investigation to determine if "the state has shown lightness or has committed a criminal offense" in the management of the epidemic, said Mr. Boudi. He also denounces the "inaction" of the authorities against the spread of the virus in France.
