The Regulations are made under the Prevention and Control of Diseases Ordinance (Cap. 599) (the Ordinance). Article 8 of the Ordinance states that the Chief Executive in Council may make regulations to prevent, deal with or mitigate the effects of public health emergencies to protect public health.

The following is the full text of the gazette:

Reducing social contact is key to delaying the spread of coronavirus disease in Hong Kong in 2019. The Government will publish a gazette today (March 28) to enact the Prevention and Control of Diseases (Prohibition of Group Aggregation) Regulation (the Regulation) (Cap. 599G) to respond with decisive and severe measures Coronavirus disease outbreaks in 2019. The Regulations will enter into force at 00:00 on March 29 for a period of three months.

Under the Regulation, the Secretary for Food and Health will publish a notice in the Gazette today. The ban on group gatherings of more than 4 people in public places will take effect at 00:00 on March 29 for a period of 14 days.

The Regulation empowers the Secretary for Food and Health to prevent the grouping of more than 4 persons in public places during the specified period in order to prevent, defend, delay or otherwise control the case or spread of the specified disease.

Schedule 1 to the Regulation states that the following group gatherings will be exempted--

1. Grouping for transportation or groupings related to transportation 2. Grouping for performing government functions 3. Grouping for fulfilling responsibilities of statutory bodies or government advisory bodies Gathering 4. Group gatherings for work in the workplace 5. Group gatherings for the provision, acquisition or reception of hospital or health care services at a medical institution 6. Group gatherings for the same household who live together 7 Group gatherings necessary for legal proceedings in courts, magistrates or tribunals 8. Group gatherings necessary for proceedings in the Legislative Council or District Councils 9. Group gatherings at funerals or mourning Or group gatherings on occasions to commemorate ancestors who have not yet been buried or cremated, including rituals to mourn the death of their ancestors near the place where their ancestors died or near the place where they suffered fatal injuries Or ceremonies 10. Groups of no more than 20 people at the wedding, provided that no food or drinks are served at the wedding 11.
