Almost two years after a wedding party got out of hand in Höhenried, the regional court of Munich II has now ruled. The aftermath is expensive for the groom.
Höhenried / Tutzing - A groom from Tutzing will probably remember his wedding in June 2017 with mixed feelings. The feast at Höhenried Castle was quite dying because of a fight between two men fighting over a woman - until the groom intervened and inflicted an eightfold open leg fracture on one of the men. The result: the Tutzinger has to pay 10,000 euros in pain compensation to his guest. So it decided a civil chamber at the district court Munich II.
The reason was the former partner of a guest
The bride and groom hadn't even asked for the opening dance when the mood was said to have been poisoned. The guest from Esslingen clashed with his girlfriend's former partner. There was a dispute between the two men because the later victim had been provoked all evening. He was shown the stink finger, a glass of wine poured into his face and his elbow against his chest.
Groom kicked the victim, which resulted in an open break
Then the guest from Esslingen burst his collar and he gave his opponent two waders. The groom, who had watched the action, pulled the opponents apart and the guest backwards. The man fell and was kicked by Tutzinger, which ultimately led to the serious injury.
The groom had always denied this kick. According to an expert, the serious injury could not have resulted from a fall alone, but had to be the result of the kick, even if no other guest had seen it. It was not surprising, the expert said. In such a tumultuous event, the eyes are more on the head and chest than on the calf area. The lower leg was hardly visible from the distance of the witnesses.
Victim is at fault
The plaintiff originally claimed 20,000 euros in damages. However, because the court saw a certain degree of negligence on him - after all, he had previously complained - there were only half. In addition, he also has to bear his own lawyer and part of the court costs - a considerable amount because the court costs of 1113 euros are well over 5000 euros for the costs of taking evidence.
