Mandelblit-Eldad Conflict: A Little Chance to Test | Israel today

2020-04-26T17:26:23.260Z

This is how the State Comptroller's Office is estimated • Today, the State Attorney's request was received to check on the involvement of the High Court in the Harpaz case

The State Comptroller's Office received a request from the State Attorney General Eldad to check the court's involvement in the Harpaz affair • Factors in the Comptroller's Office: "Closed reports do not open"

Acting State Attorney Dan Eldad sent his reply letter to Civil Service Commissioner Prof. Daniel Hershkowitz on Sunday following Attorney General Dr. Abihai Mandblit's claim that there is legal impediment to extending his term. This evening, Eldad responded: We can elaborate beyond that. "

At the same time, the State Attorney's Office contacted State Comptroller Mattiahu Engelman to open an inquiry into the US Attorney's involvement in the Harpaz case. "Today Israel" has learned that Eldad's appeal spans about half a page and does not contain anything but a reference already made to a journalist's statement about Mandelblit's involvement in the Harpaz affair and allegedly feared to impair the purity of the measurements.

State Attorney Eldad said: "Naturally, the appeal is not intended to examine criminal aspects. The appeal is focused on other aspects of dealing with Dr. Mandelblit's case rather than his own actions. "

Sources at the State Comptroller's Office added that "the prospect of opening an investigation is very small. This is a signed report eight years ago. Closed reports never open, even when critics are asking, and there is a non-communicative quarrel here between us and the attorney general.

The decision of the State Commissioner regarding Mandelblit's comments will be taken until the end of Eldad's term on May 1.

State Comptroller's Response: "The request was received several hours ago at the State Comptroller's Office. The Comptroller will learn the reference and details in depth and will respond directly to the State Attorney's Office."

The mediated battle between President Mandelblit and Attorney Eldad began last Thursday, when the advisor issued an unprecedented letter he sent to the Civil Service Commission, claiming that there was a legal impediment to extend the tenure of Deputy Attorney General.

Eldad responded to the letter, explaining that "before the holiday, a journalist came to my office dealing with Avichai Mandelblit's case. In order for me to respond to the request, I asked to examine the past material on this subject at the State Attorney's Office.

A day later, a series of senior prosecutors voiced public support for the consultant. The supporters who led the "rebellion" and urged not to cooperate with Eldad - Liat Ben Ari and Nurit Litman who were nominated by the Judea and Samaria to fill the post and the counsel's harsh letter against Eldad relied on the former's opinion.

"We wish to clarify in this letter our unqualified support and full confidence in Attorney General, Dr. Mandelblit," wrote the State Attorney's Office. "We have full confidence in the Attorney General and what he wrote in a letter sent to the Civil Service Commission last night. Unfortunately, the content of what it describes about how you operate in the prosecutor's office reflects incorrectly the reality we have been experiencing since taking office. "

They are also shocked that "instead of addressing the allegations of their bodies, you have chosen to impose a slime on the Attorney General and his motives to oppose the extension of your appointment, while proactively publishing a review that you conduct according to your message. Although such a covert review is being made, it has been published to deal with its legal claims. The Attorney General, is an act that will not be done, which fundamentally undermines its secrecy and effectiveness and is contrary to any basic value of the attorney's work. As such an examination does, the sole purpose of its publicity appears to be to serve as a dig for digging up the attorney general's justifiable criticism of you.

At the same time, an opinion was published with the support of a consultant from dozens of senior private attorneys: "Dr. Mandelblit has for years been a professional and decent lawyer. We oppose any attempt to intimidate or weaken it, including any attempt to force a senior member of the law enforcement system unacceptable. Every effort will be made to preserve the rule of law and to protect enforcement agencies, headed by the Attorney General. "

Senior Justice Department officials told Israel Today that Eldad was considered an excellent but "poor manager" and that he was not "one of the clichés" and therefore opposed him in the first place. "The revolt led by Littman and Ben Ari was backed by the counsel who preferred to transfer to Moomi (Lamberger, Deputy State's Attorney for Criminal Affairs; YA) various issues and educate Eldad."
