A 92-year-old woman who lived in the nursing home in the Buenos Aires neighborhood of Belgrano who had to be evacuated last week after detecting 19 cases of coronavirus died in the early hours of this Tuesday, becoming the second death among residents , as confirmed by the lawyer for the family, who requested the arrest of the owners of the place.

Last Tuesday SAME ambulances, along with federal police personnel evacuated more than 20 people, including residents and workers, from the property located in Los Incas 3093.

"The 92-year-old woman, named Esther , died this morning in the San José sanatorium where she had been transferred after being evacuated from the nursing home," Ignacio Trimarco, lawyer for the victim's family , said in dialogue with Télam .

Likewise, the lawyer assured that the woman "had tested positive for Covid-19" and announced that "now the case is aggravated by abandonment of a person followed by death," which includes a sentence of between 5 and 15 years in prison.

"We are presenting the notification to the justice system," he said, noting that the case that he is pursuing is aimed at "the owners of the nursing home, the doctor in charge of the residents' health and the City Government."

In this sense, Trimarco assured that "the nursing home owners said that when they had knowledge of the first positive case, they notified the City health authorities, but apparently no one did anything; this is something that justice should investigate."

The lawyer also assured that "the arrest of the owners of the place and the doctor" was requested and that a request for incompetence was also presented so that the cause went to "federal jurisdiction, since it is a case that involves public health" .

The complaint also presented a request to the courts to "ratify the testimonial statements," since the "prosecution is taking these statements by telephone, and constitutional rights are not guaranteed."

According to the lawyer, in this modality "the identity of the person who is declaring cannot be verified, they cannot verify whether they are coerced, or if they read, no comptroller participates; neither the defense nor the complaint and this may cause future annulments" .

"We do not want that as a consequence of these testimonies, the declarations can be annulled and the case be dropped," the lawyer sentenced.

Last Thursday Angélica González , 89, also a resident of the nursing home, died at the La Esperanza Clinic in the Buenos Aires neighborhood of Caballito, with a positive diagnosis of coronavirus.
