Tenancy law expert: "This is outrageous"

 Hans-Michael Krepold (56), professor of civil law at the Aschaffenburg University of Applied Sciences, would like to remind you of the noble principles that the foundation takes for itself if it could get hold of someone: “Strengthen the region, give joy, to keep an eye on your neighbor, to provide uncomplicated help, ”he quotes from the Foundation's homepage. “There is an employer with a social conscience. It is outrageous to treat him like this!

According to Krepold, who has been advising the family for years and whose wife represents the Rettingers as a lawyer, the landlords have the right on their side. On his advice they kept the April rent up to 100 euros. "If the foundation sues, they will fail terribly!" The tenant law expert refers to the legal prohibition of dismissal on March 25, according to which no tenant may lose their apartment or business because of Corona.

The amendment to the law had become necessary because previous legislation was not always clear. If you do not pay two months' rent, you face termination without notice. Under certain circumstances, however, it is enough if a “not inconsiderable part” of the rent is missing for two consecutive months, ie 1 month's rent plus 1 cent. And: The statutory prohibition of termination of March 25 applies to rental arrears that run from April 1 to June 30. Not for residues that existed before April. Payment problems must also be justified with Corona.

Foundation calls for credit

It remains open why the Raiffeisenbank Foundation refuses to accommodate them. The ban on dismissal was already under discussion when Rettingers were asked to contact their house bank. Attorney Christine Krepold-Zimmer reacted angrily: The foundation is well aware that loans like these cannot be obtained without security in times like these. "With your behavior, you are a prime example of what should not be done in our country at the moment," she criticizes the foundation in a letter.

Legal professor Krepold can only speculate about the reasons: he would not be surprised if the property should be marketed otherwise, he speculates: “The 4000 square meters are just the economy. There will definitely be more possible. ”Despite repeated inquiries, the Foundation was unable to reach anyone to comment.
